Dundee City Licensing Board - 19/04/2018

At a MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 19th April, 2018.

I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant the above application, subject to the minimum entry charge condition being attached to the licence.

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant the above application, subject to a minimum food charge of 10 condition being attached to the licence.

(b) VARIATIONS (MAJOR)

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant a variation to change to on-sale only; remove off-sales hours; the premises management will operate all general extensions of hours offered by City of Dundee Licensing Board including festive season and blues/jazz festival extensions; include restaurant and bar meals; permit activity before core hours (no alcohol sales before core hours unless extended hours application granted); permit recorded music, televised sport to be played before core hours (no alcohol sales before core hours unless extended hours application granted); add in theatre, film and indoor/outdoor sports; all activities can commence at 9am; add Comedian, magician, musicians, poker nights, race nights, sports/local club prize givings and celebrations, compensate with a community bar, and reduce capacity to 130".

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant a variation to include off-sales hours; on-sales hours to commence at 11am Sundays; off sales from 10am-10pm daily for marketing and promotional events; to include seasonal variations The premises licence holders will operate all general extended hours offered by the licensing authority for the City of Dundee including the current festive season/blues and jazz weekend hours and other general extensions as from time-to-time may be made by the licensing authority"; to add in restaurant and bar meals; add in gaming (charity casino or race nights); to permit live performances to take place before but not after core hours; supplementary statement first sentence to read All events in column 4 can commence at 8am, carry on through core hours but not after core hours but generally the events will commence as undernoted; Children (accompanied by an adult) and young persons will be allowed access to the premises; children will not be able to access the bar area when it is open for the sale of alcohol; young persons carrying appropriate age ID will be able to access the bar area for the purposes of purchasing non-alcoholic refreshments, Birth-17 to be permitted; children accompanied by an adult and young persons may access the premises at all times premises are open and accompanied children and young persons may access all public parts of the premises under exception that children may not access the bar area when it is open for the sale of alcohol.

(i) INDUSTRY, 5 SEAGATE, DUNDEE

Councillor Alexander declared a non-financial interest by virtue of having knowledge of the applicant, left the Chamber and took no part in the debate.

The Board, having heard from an agent on behalf of the applicant, the Chief Constables representative and the Boards Legal Adviser, agreed to grant the application for 6th and 27th May, 2018, to refuse the application for 4th and 5th May, 2018 and to defer consideration of the remaining applications to the Board meeting on 17th May, 2018.

IV PREMISES LICENCE REVIEW

(i) OLD BANK BAR, 34 REFORM STREET, DUNDEE

The Board, having heard from an agent on behalf of the applicant and the Board's Legal Adviser, agreed to discharge the review, and to take no further action.

V PERSONAL LICENCE APPLICATION

(i) STANLEY PETRIE

The Board, having heard from the applicant on their own behalf, the Chief Constables representative and the Boards Legal Adviser, the Convener moved to grant the above application, subject to a 12 month recall.

As an amendment, Councillor Lynn moved to grant the above application without recall.

On a division, there voted for the motion - the Convener and Councillors Murray, Gordon, Cruickshank, Scott and Bailie Keenan (6) - and for the amendment - Councillors Alexander and Lynn (2) - whereby the motion was declared carried.

VI REQUEST FOR LICENCE REVIEWS

(i) PERSONAL LICENCE

The Board agreed to hold a personal licence review in respect of Rana Aslam.

(ii) PREMISES LICENCE

The Board agreed to hold a premises licence review in respect of the Old Bank Bar, 34 Reform Street, Dundee.
