The Board having heard from the Boards Legal Adviser, Councillor Lynn moved to grant the application. As an amendment, Councillor Gordon moved to defer the above application.
On a division, there voted for the motion - Councillors Murray, Alexander, Lynn and Scott (4); and for the amendment - the Convener and Councillors Gordon and Cruickshank (3) - whereupon the motion was carried granting the application.

The Board, having heard from an agent on behalf of the applicant and the Board's Legal Adviser, agreed to a variation to background music, digital music playback system from opening until midnight Monday to Sunday. DJ/Disco and live performance from opening until 2.30 am Sunday to Thursday and opening until 3.00 am Friday/Saturday in the basement area. Minimum entrance charge to operate.
Musical entertainment for ground and first floor to remain as stated on the licence, however, note that no live music after 12 midnight does not include basement.
Add late night opening premises on-consumption hours to the basement area only from Sunday to Thursday from 11.00 am to 2.30 am and Friday/Saturday 11.00 am to 3.00 am.
Add access to Children and Young Persons to include access to the basement area for private functions only when they are not being used as a nightclub and hours for basement for the duration of a private function when not being used as a nightclub.
Amend the capacity of the premises from 184 to 263.

(a) REVIEW HEARINGS
(i) Robert Palmer
The Board, having heard from the Chief Constable's representative, the Licensing Standards Officer and the Boards Legal Adviser, agreed to revoke the licence.
(ii) Fraser Rolley
The Board, having heard from the Chief Constable's representative, the licence holder on their own behalf, and the Board's Legal Adviser, agreed to take no further action.
(iii) Craig Fox
The Board, having heard from the Chief Constable's representative, the licence holder on their own behalf, and the Board's Legal Adviser, agreed to suspend the licence for two months.
(b) NEW APPLICATIONS
(i) Stanley Petrie
The Board, having heard from the Chief Constable's representative and the Board's Legal Adviser, agreed to defer the above application to the April meeting of this Board.
IV PREMISES LICENCE - REQUEST FOR REVIEW
The Board agreed to hold a premises licence review in respect of the Old Bank Bar, 34 Reform Street, Dundee.
