Dundee City Licensing Board - 18/01/2018

At a MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 18th January, 2018.

The minute of meeting of this Board of 22nd November, 2017 was held as read.

 

Prior to the commencement of business, the Convener highlighted work undertaken by Trading Standards in the run up to Christmas 2017. Test purchases were made at a number of licensed premises where it was found that short measures of spirits had been sold. The Convener found this disappointing and noted that further investigatory work was ongoing.

 

I OVERPROVISION ASSESSMENT UNDER LICENSING (SCOTLAND) ACT 2005 - RESULTS OF CONSULTATION

 

The Board acceded to a request for deputations to address the Board for and against the above.

 

After the deputations had stated their case and answered questions from members of the Board, they were thanked for their attendance and withdrew.

 

Thereafter, there was submitted Report No 24-2018 by the Clerk to the Licensing Board advising the Board of the outcome of the consultation on whether, and, if so, to what extent there was an overprovision of licensed premises within its area under Section 7 of the Licensing (Scotland) Act 2005.

 

The Board agreed to adopt a policy on overprovision which states that it will apply to off-sales premises throughout the whole of the Boards area. It was further agreed that only applications received after 18th January, 2018 would be subject to the new policy and a review of the policy would be carried out at the end of a twelve month period, as part of the overall review of the Statement of Licensing Policy.

 

II REQUEST FOR PREMISES LICENCE HEARINGS

 

The Board agreed to hold Premises Licence hearings in respect of Don Michele, 177-179 Perth Road, Dundee, McAdams Bar, 77 Rosebank Street, Dundee and Slavic Goods, 140 Victoria Road, Dundee.

 

III REQUEST FOR PERSONAL LICENCE HEARING

 

The Board agreed to hold a Personal Licence hearing in respect of Robert Palmer.
