The minute of meeting of this Committee of 2nd November, 2017 was held as read.
Unless marked thus * all items stand delegated.
Prior to the commencement of the business the Convener reported on the sad passing of Mr David Young, Chief Executive of Dundee 203020 Private Hire Ltd and paid tribute to the personal contribution he had made over his years of involvement in the taxi trade and as a long standing member of the Taxi Liaison Group and that the thoughts of the Licensing Committee were with his wife and family at this time.

The minutes of meetings of the Licensing Sub-Committee held on 5th October, 2017, 17th October, 2017, 2nd November, 2017 and 6th November, 2017 were submitted and noted for information and record purposes, copies of which are attached to this minute as Appendices l, ll, lll and IV.

In the case of Application No 1, the Committee noted that an application had been made for a Taxi Licence to replace an existing Taxi Operators Licence with an electric vehicle. The existing licence holder was George Adam, OP337. Directors of Khan Cabs Ltd were George Adam and Wasif Khan. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted.
In the case of Application No 2, the Committee noted that an application had been made for a Taxi Licence to replace an existing Taxi Operators Licence with an electric vehicle. The existing licence holder was David Cox, OP233. Directors of Kash Taxis Ltd were David Cox and Faisal Arshad. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted.
In the case of Application No 3, the Committee noted that an application had been made for a Taxi Licence to replace an existing Taxi Operators Licence with an electric vehicle. The existing licence holder was Ulick Malcolm, OP387. Directors of R A Taxis Ltd were Ulick Malcolm, Farees Ahmed and Raees Ahmed. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted.
In the case of Application No 4, the Committee noted that an application had been made for a Taxi Licence to replace an existing Taxi Operators Licence with an electric vehicle. The existing licence holder was David Gilchrist, OP666. Directors of S A Cabs Ltd were David Gilchrist, Mohammed Asif and Sajid Sharif. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted.
In the case of Application No 5, the Committee noted that an application had been made for a Taxi Licence to replace an existing Taxi Operators Licence with an electric vehicle. The existing licence holder was Robert Cumming, OP352. Directors of Waterfront Taxis Ltd were Robert Cumming and Mohammed Zubair Hashmi. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted.

In the case of this application, the Committee noted that a request for variation had been made to allow for the white plate on the vehicle used in the operation of the licence to be replaced with a special events disc.
Thereafter, having heard the Legal Officer and receiving confirmation that the applicant had requested that consideration of the application be deferred to allow them to be present, the Committee agreed that consideration of the application be deferred to the meeting of this Committee to be held on 11th January, 2018.

In the case of Application No 1, the Committee noted that a request for variation had been submitted to change the day to day manager to Gowrie Care Ltd. There being no objections, the Committee agreed that the application be granted.
In the case of Application No 2, the Committee noted that a request for variation had been submitted to change the day to day manager to Robertson Property Management. There being no objections, the Committee agreed that the application be granted.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.
V CIVIC GOVERNMENT (SCOTLAND) ACT 1982
(a) LATE HOURS CATERING - NEW APPLICATION
Reference was made to Article V(a) of minute of meeting of this Committee held on 2nd November, 2017, wherein it was agreed to defer consideration of the application submitted by Company F for a Late Hours Catering Licence to this meeting of the Committee to allow the applicant to be in attendance.
There was submitted an application by Company F for a Late Hours Catering Licence. There was also submitted the original letter of objection dated 17th October, 2017 from the Licensing Standards Officer and a letter of observation from Neighbourhood Services (Environment Section). The Committee gave consideration to the content of the documentation. Thereafter, having heard the Licensing Standards Officer, a representative on behalf of the applicant and consideration of the advice of the Legal Officer, the Committee agreed that it be delegated to the Head of Democratic and Legal Services, in consultation with the Convener, to determine the application subject to the applicant submitting all relevant paperwork to the satisfaction of the Licensing Office and that in the event of non-submission that the application be resubmitted to the meeting of the Licensing Committee to be held on 11th January, 2018 for determination.
(b) SECOND HAND DEALER - NEW APPLICATION
There was submitted an application by Ms L N for a Second Hand Dealers Licence. There was submitted a note of observations from the Environment Department relevant to this application.
The Committee noted that the applicant was not present and having considered the advice of the Legal Officer, the Committee agreed that consideration of the application be deferred to the meeting of this Committee to be held on 11th January, 2018.
(c) TAXI DRIVERS LICENCE - RENEWAL APPLICATION
Reference was made to Article V(i)(i) of the minute of meeting of this Committee held on 5th October, 2017, wherein it was agreed to grant the application by Mr M K for a Taxi Drivers Licence until 7th December, 2017 and to recall the matter to this meeting of the Committee for an update on the licence holders immigration status in relation to being allowed to remain in the United Kingdom. There was submitted the original letter of information from the Licensing Standards Officer in relation to the application by Mr M K for renewal of his Taxi Drivers Licence.
The Committee noted that the applicant was not present and agreed that the matter be considered in their absence. Thereafter, having received confirmation of Mr M Ks right to remain as a resident in the United Kingdom had expired following the refusal of his appeal on 16th October 2017, the Committee agreed that the application be refused.
(d) TAXI OPERATOR - REQUEST FOR VARIATION
Reference was made to Article V(j)(ii) of the minute of meeting of this Committee held on 5th October, 2017, wherein it was agreed to grant the request for variation to the Taxi Operators Licence held by Mr J G to appoint Mr J R as day to day manager in the operation of the licence until this meeting of the Committee to allow the applicant to be in attendance.
There was submitted the original letter of request which had been submitted to vary the terms of the Taxi Operators Licence held by Mr J G. Thereafter, having heard representatives on behalf of the applicant, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to further extend the variation of the Taxi Operators Licence held by Mr J G until the meeting of this Committee to be held on 1st February, 2018 for an update to be provided on the matter.
(e) TAXI DRIVERS LICENCE - SUSPENSION HEARINGS
(i) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 6th November, 2017, wherein the Taxi Drivers Licence held by Mr C M was suspended with immediate effect and it was agreed that a hearing be held in relation to the fitness of Mr C M to be a holder of a Taxi Drivers Licence. There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr C M during the currency of his Taxi Drivers Licence. There was submitted a letter of support from the agent on behalf of the licence holder and a further letter of support which had been tabled by the agent on behalf of the licence holder. The Committee gave consideration to the content of the documentation. Thereafter, having heard the representative of the Chief Constable, the agent on behalf of the licence holder, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to adjourn the hearing in relation to the suitability of Mr C M to be the holder of a Taxi Drivers Licence to the meeting of this Committee to be held on 1st February, 2018, to await the outcome of court proceedings and to continue the suspension of the Taxi Drivers Licence held by Mr C M during the intervening period with immediate effect.
(ii) Reference was made to Article VII(l)(viii) of the minute of meeting of this Committee held on 7th September, 2017, wherein it was agreed to recall the suspension of the Taxi Drivers Licence held by Mr C S and to grant the application by Mr C S for renewal of his Taxi Drivers Licence and to recall the matter to this meeting of the Committee for an update on the operation of the licence. There was submitted an original letter of information from the Chief Constable in relation to the alleged conduct of Mr C S during the currency of his Taxi Drivers Licence and the original letter of objection to the application by Mr C S for renewal of his Taxi Drivers Licence. Thereafter, having heard the representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken.
(iii) Reference was made to Article V(k)(ii) of the minute of meeting of this Committee held on 5th October, 2017, wherein it was agreed to adjourn the hearing in relation to the suitability of Mr J T to be the holder of a Taxi Drivers Licence to this meeting of the Committee to await the outcome of court proceedings. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr J T during the currency of his Taxi Drivers Licence. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken.
(iv) Reference was made to Article I(d)(iv) of the minute of meeting of the Licensing Sub‑Committee held on 5th October, 2017, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr M Y during the currency of his Taxi Drivers Licence. There were submitted letters of complaint which had been received from members of the public relevant to the alleged conduct of Mr M Y during the currency of his Taxi Drivers Licence, a letter of support which had been submitted by the licence holder and a further letter of complaint which had been received from a member of the public. The Committee gave consideration of the content of the documentation. Thereafter, having heard the representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice from the Legal Officer, the Committee agreed that no further action be taken.
(f) TAXI DRIVER'S/TAXI OPERATOR'S LICENCE - SUSPENSION HEARINGS
(i) Reference was made to Article V(m) of the minute of meeting of this Committee held on 5th October, 2017, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Ms A B during the currency of her Taxi Drivers Licence and Taxi Operators Licence to this meeting of the Committee to await the outcome of court proceedings. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Ms A B during the currency of her Taxi Drivers Licence and Taxi Operators Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to adjourn the hearing to the meeting of this Committee to be held on 1st March, 2018.
(ii) Reference was made to Article VIII(m)(ii) of the minute of meeting of this Committee held on 7th September 2017, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr K M during the currency of his Taxi Drivers Licence and Taxi Operators Licence to this meeting of the Committee to await the outcome of court proceedings and to grant the application by Mr K M for renewal of his Taxi Licence during the intervening period. There was submitted an original letter of information from the Chief Constable relevant to the alleged conduct of Mr K M during the currency of his Taxi Drivers and Taxi Operators Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to further adjourn the hearing in relation to the alleged conduct of Mr K M to the meeting of this Committee to be held on 29th March, 2018 to await the outcome of court proceedings.

(a) TAXI DRIVERS LICENCE SUSPENSION HEARINGS
(i) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 13th July, 2017, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr W H during the currency of his Taxi Drivers Licence.
There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr W H during the currency of his Taxi Drivers Licence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard a representative of the Chief Constable, the licence holder on his own behalf and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that no further action be taken and that the licence holder be issued with a verbal warning as to their future conduct.
(ii) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 29th June, 2017, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr M J during the currency of his Taxi Driver's Licence.
There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr M J during the currency of his Taxi Drivers Licence. There was also submitted a further letter of information from the Licensing Standards Officer.
The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard a representative of the Chief Constable, the Licensing Standards Officer, an agent on behalf of the licence holder, and consideration of the advice of the Legal Officer, the Sub‑Committee agreed to adjourn the hearing until the meeting of this Sub‑Committee to be held in January, 2018 to await the outcome of court proceedings and the appeal to the Home Office to remain resident within the United Kingdom.
(iii) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 15th June, 2017, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr G M during the currency of his Taxi Driver's Licence.
There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr G M during the currency of his Taxi Drivers Licence.
The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed to adjourn the hearing until the meeting of this Sub‑Committee to be held on 3rd November, 2017 to allow for evidence that the fine placed upon the licence holder had been paid.
(iv) There was submitted a letter of information from the Licensing Office relevant to the alleged conduct of Mr A M during the currency of his Taxi Drivers Licence.
The Sub-Committee gave consideration to the content of the letter.
The Sub-Committee noted that the licence holder had been observed parking indiscriminately and that he had been previously warned to stop the practice.
Thereafter, having heard the licence holder on his own behalf and consideration of the advice of the Legal Officer, the Sub-Committee agreed that no further action be taken and that the licence holder be issued with a written warning as to their future conduct.
(v) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 29th June, 2017, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr H O'S during the currency of his Taxi Drivers Licence.
There was submitted a note of information from the Licensing Office relative to the alleged conduct of Mr H O'S during the currency of his Taxi Driver's Licence.
The Sub-Committee gave consideration to the content of the note.
Thereafter, having heard a representative on behalf of the licence holder, the licence holder on their own behalf, and consideration of the advice of the Legal Officer, the Sub‑Committee agreed to adjourn the hearing in relation to the fitness of Mr H O'S to be the holder of a Taxi Driver's Licence to the meeting of this Sub‑Committee to be held in January, 2018 to allow the licence holder to attend the PAM Group to establish his medical fitness to be the holder of a Taxi Drivers Licence, in terms of Section 13(4) of the Civic Government (Scotland) Act 1982 during the intervening period.
(b) TAXI OPERATORS LICENCE - SUSPENSION HEARINGS
(i) Reference was made to Article II(f) of the minute of meeting of this Sub-Committee held on 29th June, 2017, wherein it was agreed to adjourn consideration of the hearing in relation to the alleged conduct of Company F during the currency of their Taxi Operator's Licence to this meeting of the Sub-Committee at the request of the agent on behalf of the licence holder.
There was submitted a letter of information from the Plant and Vehicle Officer relevant to the alleged conduct of Company F during the currency of their Taxi Operator's Licence. There was also submitted a letter of support from the agent on behalf of the licence holder.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard the Plant and Vehicle Officer, an agent on behalf of the licence holder, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that no further action be taken.
(ii) Reference was made to Article II(c) of the minute of meeting of this Committee held on 30th March, 2017, wherein it was agreed to adjourn consideration of the hearing in relation to the alleged conduct of Mr G A during the currency of his Taxi Operator's Licence to allow for improvement in their methods to be ascertained.
There was submitted a letter of information from the Plant and Vehicle Officer relevant to the alleged conduct of Mr G A during the currency of his Taxi Operator's Licence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard the Plant and Vehicle Officer, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Sub-Committee agreed that no further action be taken.
(c) TAXI OPERATORS LICENCE - UPDATE
Reference was made to Article II(c) of the minute of meeting of this Sub-Committee held on 30th March, 2017, wherein it was agreed to issue a verbal warning to Mr M K to the conduct of Mr M K during the currency of his Taxi Operator's Licence and to adjourn the matter to this meeting of the Sub-Committee for an update on the operation of the licence.
There was submitted a letter of information from the Plant and Vehicle Officer relevant to the alleged conduct of Mr M K during the currency of his Taxi Operator's Licence.
The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

(d) TAXI DRIVERS LICENCE REQUEST FOR SUSPENSION HEARINGS
(i) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr C M during the currency of his Taxi Drivers Licence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr C M to be the holder of a Taxi Driver's Licence.
(ii) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr S M during the currency of his Taxi Drivers Licence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr S M to be the holder of a Taxi Driver's Licence.

Thereafter, having considered the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr M Y to be the holder of a Taxi Driver's Licence.
(v) There was submitted a letter of information from the Environmental Compliance Manager relative to the alleged conduct of Mr B McG during the currency of his Taxi Drivers Licence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having considered the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr B McG to be the holder of a Taxi Driver's Licence.
(vi) There was submitted a letter of information from the Environmental Compliance Officer relative to the alleged conduct of Mr I B during the currency of his Taxi Drivers Licence.
The Sub-Committee gave consideration to the content of the letter.
Thereafter, having considered the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr I B to be the holder of a Taxi Driver's Licence.
