The minute of meeting of this Committee of 16th January, 2017 was held as read.

I DECLARATION OF INTEREST

 

Councillor Asif made a non-financial declaration in respect of Item II(a) by virtue of being a neighbour to this development.

 

II PLANNING APPLICATIONS

 

(a) 16-00638-FULL - TO NORTH OF 1-7 LOTHIAN CRESCENT, DUNDEE - PROPOSED ERECTION OF NEW PRIMARY SCHOOL AND NURSERY - FOR DUNCAN MYRES

 

The Committee approved the application, subject to the conditions recommended by the Executive Director of City Development and together with the additional conditions:-

 

(i) details of the proposed location and type of cycle and scooter provision including storage for staff and pupils must be agreed before any works on site; and

 

(ii) the current Travel Plans for the existing three schools shall be amalgamated into one Travel Plan for the new school within one year of the school opening. A new Safe Routes to School leaflet shall be issued to all parents and carers prior to the opening of the new shared campus school.

 

(b) 16-00735-FULL - FLAT 2, 57A PERTH ROAD, DUNDEE - PROPOSED HOUSE OF MULTIPLE OCCUPATION - FOR CENTURY 21 HOMES LTD

 

The Convener, seconded by Councillor Hunter, moved approval of the application, subject to the conditions recommended by the Executive Director of City Development.

 

As an amendment, Councillor Macpherson, seconded by Councillor McCready, moved refusal of the application on the grounds that:-

The application is contrary to Policy 15 of the Adopted Dundee Local Development Plan 2014, in relation to the change of use of a flat to an HMO within a property with a shared entrance.

 

There are no material considerations of sufficient weight to allow a departure from this policy.

 

On a division, there voted for the motion - the Convener, Bailies Sawers and Borthwick and Councillors Guild, Alexander, Black, Hunter, Murray, Ross, Short, Asif, Brennan (12); and for the amendment - Depute Lord Provost Roberts, Bailies Wright and Scott and Councillors Campbell, Cordell, Lynn, McDonald, Keenan, Bidwell, Cruickshank, Gordon, McCready, McGovern and Macpherson (14) - whereupon the amendment was declared carried.

 

(c) 16-00884-FULM - DEVELOPMENT GROUND - LUNDIE AVENUE - FOOTBALL GROUND, KING'S CROSS ROAD, DUNDEE - DEVELOPMENT OF MOTOR DEALERSHIPS AND NEW SPORTS AND COMMUNITY HUB

 

The Committee acceded to a request for a deputation to address the Committee relative to objections to the above application. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, Bailie Borthwick, seconded by Councillor Ross, moved that this application be deferred to allow for clarification of environmental issues.

 

As an amendment, the Convener, seconded by Councillor Black, moved that the application be not deferred.

 

On a division, there voted for the motion - the Depute Lord Provost Roberts, Bailies Sawers, Wright and Borthwick and Councillors Alexander, Cordell, Hunter, McDonald, Murray, Ross, Short, Asif, Bidwell, Cruickshank, Gordon and McCready (17); and for the amendment - the Convener and Councillors Guild, Black, Campbell, Lynn, Keenan and Brennan (8) - Bailie Scott being absent during part of the consideration of the application - whereupon the motion was declared carried and the application was deferred.

 

III PLANNING APPEAL DECISIONS

 

There was submitted Agenda Note AN18-2017 advising of the undernoted appeal decision:-

 

(a) LAND SOUTH OF CLATTO GARDENS

 

Planning application reference 16-00349-PPPM sought Planning Permission in principle for a residential development with access from Clatto Gardens (renewal of 12-00780-PPPM) at Land to South of Clatto Reservoir, Dalmahoy Drive, Dundee. The application was approved by the Development Management Committee at its meeting on 20th June, 2016. The planning permission was subject to the following condition which was the subject of the appeal:-

 

Condition 18: prior to the development hereby approved commencing on site, a footway on the west side of Dalmahoy Drive (from the junction with Clatto Gardens to the junction with Garden Mill Place) shall be created to an adoptable standard, in accordance with details which have been agreed in writing by the Council. For the avoidance of doubt, details of the proposed footway shall be submitted to the Council for written approval prior to its formation on the west side of Dalmahoy Drive.

 

The appointed Reporter ALLOWED the appeal and varied the planning permission by deleting Condition 18. The Reporter concluded that the condition was not necessary or reasonable on the basis that the footway had already been formed by the Council.

 

IV DELEGATED APPLICATIONS

 

There was submitted Agenda Note AN19-2017 advising the Committee that from 27th November, 2016 to 31st January 2017, 106 applications were decided under delegated powers. Eighteen of those applications attracted objections, 12 of which were approved and six of which were refused.
