III 2018 REVIEW OF UK PARLIAMENTARY CONSTITUENCIES

 

There was submitted Report No 22-2017 by the Head of Democratic and Legal Services relative to the above.

 

Bailie Sawers, seconded by Councillor Short, moved approval of the undernoted resolution:-

 

Dundee City Council notes that this boundary review, and subsequent reduction in elected MPs from 650 to 600 comes at a time when the unelected House of Lords is being increased in numbers. The Council fundamentally disagrees with the increasing imbalance between the number of elected MP's and the number of unelected peers. Furthermore, there are now more unelected Scottish peers than elected Scottish MP's.

 

Dundee City Council believes that given the UK Government's intention to leave the European Union, and the subsequent increase in workload for MP's scrutinising legislation currently in the remit of the EU, is a further argument against cutting the number of MP's.

 

Dundee City Council does not believe that the City's increasing population is being taken into consideration nor the fact that Dundee has over 21,000 students who traditionally are under-represented in electoral registration. Additionally, as with other cities throughout the UK, there are large numbers of transient residents who also are under-registered.

 

Dundee City Council therefore instructs the Chief Executive to write to the Boundary Commission for Scotland outlining our opposition to boundary changes at this time.

 

Bailie Scott moved that no action be taken but failed to find a seconder, whereupon he asked for his dissent to be recorded and the motion was declared carried.

 

IV DUNDEE REP AND SCOTTISH DANCE THEATRE

 

It was reported that Councillor Black had resigned from the above Board.

 

The Council agreed that the vacancy be filled by Councillor Lynn.

 

V DUNDEE CITY COUNCIL (BUTTERBURN SQUARE, HILLTOWN, DUNDEE) COMPULSORY PURCHASE ORDER2017

 

On a reference to Article IX of the minute of meeting of the City Development Committee of 12th December, 2016, the Council resolved to make and enact the above Order, a copy of which is appended hereto.

HOUSING (SCOTLAND) ACT 1987

THE ACQUISITION OF LAND (AUTHORISATION PROCEDURE) (SCOTLAND) ACT 1947

DUNDEE CITY COUNCIL (BUTTERBURN SQUARE, HILLTOWN, DUNDEE) COMPULSORY PURCHASE ORDER 2017

 

DUNDEE CITY COUNCIL (hereinafter referred to as "the acquiring authority") in exercise of the powers conferred on them by Sections 9 and 10 of the Housing (Scotland) Act 1987 hereby make the following Compulsory Purchase Order:-

 

1. This Order may be cited as the Dundee City Council (Butterburn Square, Hilltown, Dundee) Compulsory Purchase Order 2017.

 

2. Subject to the provisions of this Order, the acquiring authority are hereby authorised to purchase compulsorily for the purpose of the erection of houses by persons other than the local authority and for the use for purposes necessary, desirable for or incidental to the development as a building estate, the land which is described in the Schedule hereto and forms part of the subjects delineated in red, coloured red, red and hatched, blue and green on the maps signed with reference to this Order and marked either "Map 1, 2, 3 or 4 referred to in the Dundee City Council (Butterburn Square, Hilltown, Dundee) Compulsory Purchase Order 2017.

 

3. In relation to the foregoing purchase Section 70 of the Railways Clauses Consolidation (Scotland) Act 1845 and Sections 71 to 78 of that Act as originally enacted and not as amended for certain purposes by Section 15 of the Mines (Working Facilities and Support) Act 1923 are hereby incorporated with the enactment under which the said purchase is authorised, subject to the modifications that references in the said sections to the company shall be construed as references to the acquiring authority and references to the railway or works shall be construed as references to the land authorised to be purchased and any buildings or works constructed or to be constructed thereon.
