As an amendment, Councillor Cordell moved to grant the application.

 

On a division, there voted for the motion - the Convener and Councillor Gordon (2); and for the amendment - Depute Lord Provost Roberts and Councillors Murray, Hunter, Cordell and Cruickshank (5) - whereupon the amendment was declared carried, granting the above application.

The Board, having heard from an agent on behalf of the applicant and the Board's Legal Adviser, agreed to grant a variation to allow addition of basement area bar/diner/entertainment venue linked to the upper two floors for the service of food, extend core hours from daily terminal hour 10.00 pm to terminal hour Sunday to Thursday, 12 midnight, and Friday and Saturday 1.00 am. Add into activities:- receptions within and before but not after core hours, recorded music within and before but not after core hours, live performances/DJ performances within core hours, dance facilities in the basement area (occasional no dedicated dance floor) within core hours, accompanied children and young persons permitted access for the purpose of having food or hot/cold non-alcoholic drinks, subject to management approval - no person under 18 will be permitted in the basement area after 6.00 pm, children and young persons will be permitted to access all public areas above and capacity increased to 100.

Allow access to children and young persons for the duration of a private function accompanied by a responsible adult and for under 18's club nights, between the hours of 11.00 am and 10.00 pm.

 

The Board, having heard from the applicant on their own behalf, and the Board's Legal Adviser, agreed to defer the above application to the January meeting of this Board.
