Dundee City Licensing Board - 27/10/2016

At a MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 27th October, 2016.

I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board, having heard from an agent on behalf of the applicant and the Board's Legal Adviser, agreed to grant the above application.

The Board agreed to defer the above application.

The Board heard from an agent on behalf of the applicant and the Board's Legal Adviser. The Convener thereafter moved to refuse the application. As an amendment, Councillor Cordell moved to grant the application with the condition that all alcohol sold is imported.

On a division, there voted for the motion - the Convener and Councillor Brennan (2); and for the amendment - Councillors Murray, Hunter, Cordell, Gordon and Cruickshank (5) - whereupon the motion was declared carried granting the above application.

The Board, having heard from an agent on behalf of the applicant and the Board's Legal Adviser, agreed to grant the above application.

(b) VARIATIONS (MAJOR)

The Board, having heard from the applicant on their own behalf, the Board's Legal Adviser, and taken into account letters of objection, agreed to grant a variation to change to alcohol sold for on consumption only, amend consumption hours from Sunday to Thursday to 2.30am and Friday and Saturday to 3am, amend gaming to show that it cannot take place outwith core hours, amend access to children and young persons, show new layout with the removal of part of the main bar and the addition of three other smaller bar serving areas and change capacity from 600 to 740. Minimum charge to be applied.

Variation to allow addition of basement area bar/diner/entertainment venue linked to the upper two floors for the service of food, extend core hours from daily terminal hour 10pm to terminal hour Sunday to Thursday 12 midnight, and Friday and Saturday 1am. Add into activities:- receptions within and before but not after core hours, recorded music within and before but not after core hours, live performances/DJ performances within core hours, dance facilities in the basement area (occasional no dedicated dance floor) within core hours, accompanied children and young persons permitted access for the purpose of having food or hot/cold non-alcoholic drinks subject to management approval - no person under 18 will be permitted in the basement area after 6pm, children and young persons will be permitted to access all public areas above and capacity increased to 100.

The Board agreed to defer the above application.

The Board, having heard from an agent on behalf of the applicant, and the Board's Legal Adviser, agreed to grant a variation to change the layout of the premises and increase the off-sales capacity from 33.192m2 to 44.77m2.

The Board, having heard from an agent on behalf of the applicant, the Board's Legal Adviser, and taken into account objections, agreed to a variation to allow alcohol to be sold for consumption off the premises from 11am to 10pm Mondays to Sundays.

The Board agreed to grant a variation to permit on consumption until 1am Fridays and Saturdays, receptions and club or other group meetings during core hours, recorded music outwith core hours to allow for low level music for bar staff prior to opening and allow access for children and young persons for attending football matches as per Board's policy.

(c) OCCASIONAL LICENCE

Councillors Hunter and Gordon declared a non-financial interest by virtue of being members of Leisure and Culture Dundee, left the Chamber and took no part in the debate.

The Board, having heard from the applicant on their own behalf and the Clerk, agreed to grant the above licence.

II PREMISES LICENCE - REVIEW HEARING

(i) THE TOWN HOUSE - KING STREET

The Board, having heard from an agent on behalf of the licence holder, the Chief Constable's representative and the Executive Director of Neighbourhood Services' representatives, agreed to defer the hearing to January, 2017.

III PERSONAL LICENCE - REVIEW HEARING

(i) STEPHEN TOSH

The Board, having heard from the licence holder on their own behalf, the Chief Constable's representative, and the Board's Legal Adviser, agreed to endorse the personal licence.

IV APPLICATION FOR TRANSFER OF PREMISES LICENCE - BOWBRIDGE BAR, 2 MAIN STREET TO S TAVERNS, 7A MAINS ROAD

The Board, having heard from the licence holder on their own behalf, the Chief Constable's representative and the Board's Legal Adviser, agreed to grant the above application.
