I DECLARATION OF INTEREST
Councillor Brennan declared a non-financial interest in Article II(b) by virtue of having given advice to one of the objectors and left the Chamber during consideration of this application.
II PLANNING APPLICATIONS
(a) 14-00505-FULL - 3 LINTRATHEN STREET, DUNDEE - FORMATION OF TRAINING, TEACHING AND COUNSELLING FACILITY - FOR M K FIELD
The Committee acceded to requests for deputations to address the Committee both in support of and relative to objections to the above application. After the deputation had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.
Thereafter, having considered objections received, the Committee refused the application on the grounds that the proposed development would adversely impact on the level of environmental quality afforded to neighbouring residents by virtue of the operating hours, number of people visiting the application site and level of traffic that would be generated, the noise and level of disturbance created to local residents, some of whom were sheltered tenants who were older and frail. The proposal was therefore contrary to the requirements of Policy 16 (Small Scale Commercial Uses within Residential Areas) of the Dundee Local Development Plan 2014. There were no material considerations that would justifying laying aside the provisions of the Local Development Plan to grant planning permission.
(b) 14-00586-FULL - SITE OF DOUGLAS HOUSE, BALUNIE DRIVE, DUNDEE -ERECTION OF NURSERY, COMMUNITY HUB AND BUSINESS START-UP UNITS - FOR THE FACTORY SKATEPARK
The Committee acceded to a request for a deputation to address the Committee relative to objections to the above application. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.
Thereafter, having considered objections received the Convener, seconded by Councillor Black, moved approval of the application, subject to the conditions recommended by the Director of City Development.
As an amendment, Councillor Dawson, seconded by Councillor Hunter, moved refusal of the application on the grounds that it did not satisfy Policy 16 of the Dundee Local Development Plan as it would have a substantial effect on the environmental quality enjoyed by local residents due to parking, traffic movements and noise disturbance. There were no material considerations that would justify laying aside the provisions of the Local Development Plan.
On a division, their voted for the motion - the Convener, Bailie Sawers, Councillors Black, Lynn, Melville, Ross and Macpherson (7); and for the amendment - Lord Provost Duncan, Bailies Wright, Borthwick and Scott and Councillors Guild, Alexander, Campbell, Cordell, Dawson, Hunter, McDonald, Murray, Keenan, Asif, Bidwell, Ferguson and McCready (17) - whereupon the amendment was declared carried and planning permission refused.
(c) 14-00578-FULL - 19 ROSEANGLE, DUNDEE - ERECTION OF 12 FLATS - FOR DISCOVERY HOMES SCOTLAND LTD
After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.
(d) 14-000409-FULM - FORMER DUNDEE COLLEGE, MELROSE TERRACE, DUNDEE - ERECTION OF 59 HOUSES AND ASSOCIATED ROADS AND INFRASTRUCTURE - FOR PERSIMMON HOMES (EAST SCOTLAND)
The Committee approved the application, subject to the conditions recommended by the Director of City Development.
III DELEGATED ITEMS
There was submitted Agenda Note AN244-2014 advising the Committee that from 22nd August to 21st October, 2014, 78 applications were decided under delegated powers. 12 of these applications attracted objections and all 12 were approved.
The Committee noted accordingly.
