It was reported that a request had been made by Private Hire Car Operator, Wayne O'Hare to advertise the One City, Many Discoveries logo on his private hire car, together with wording "Why Pay More" all as outlined in the document, which was submitted.

 

The Committee noted:-

 

(i) that the Council policy was that Private Hire Car Operators may advertise only their own business details on their vehicle; and

 

(ii) that the applicant was not present and agreed that consideration of the application be deferred to the next meeting of the Committee to allow the applicant to be present.

In the case of Application Nos 1 to 3, the Committee noted that the applicants were not present and agreed that the applications be considered in their absence. Thereafter, having been advised that the applicants had failed to pass the street test within the prescribed period, the Committee agreed that the applications be refused.

 

(f) TAXI DRIVER'S LICENCE - FEES - TAXI MARSHALS

 

It was reported that deputations relative to this item of business had been received from the following organisations:-

 

(a) Unite the Union (Taxi Branch)

(b) Dundee Taxi Association

(c) Dundee Hackney Association

(d) GMB Union

 

The Committee heard the deputations listed above.

 

There was submitted Agenda Note AN122-2014 reporting that there had been traffic management issues outside G Casino on Marketgait for a number of years, including taxi drivers forming an unofficial rank on zig zags on the clearway and queuing around to the official evening rank which starts at the bus stop outside Tesco's. This practice had led to drivers joining the end of the unofficial rank and effectively jumping the queue in front of those drivers sitting on an official rank. As taxis were parked immediately outside the entrance/exit of the Casino, patrons had been jumping the barriers to access them with limited awareness and concern for their safety on what was a busy clearway. In the opinion of officers, there was an ongoing public safety issue at this location at weekends.

 

Discussions had been ongoing with the Trade to try to resolve things, with the latest discussions taking place at the Taxi Liaison Group on 17th February, 2014. The Trade had, some time ago, suggested that Taxi Marshals would help resolve the situation and at that meeting, officers put forward details and costings for the employment of two taxi marshals. Their remit would be to discourage waiting on the zig zags, direct the general public to the official rank and report any drivers who persistently flout the traffic regulations to the Committee with a view to licences being suspended. Taxi marshals were currently in operation in other cities in Scotland albeit to regulate patrons rather than drivers and contributed to and enhanced a feeling of safety for evening economy patrons.

 

Some Trade members were in favour of the proposal and others against it. Following a full and frank discussion, officers indicated that they would be recommending that two taxi marshals be employed on Friday and Saturday evenings and that Trade members could ask for a deputation to put their ideas directly to members.

 

Any costs associated with taxis must be recovered. The costs associated with taxi marshals were estimated at 15,000 per annum and, as all taxi driver's licences were due for renewal at 31st May, 2014 it was recommended that two taxi marshals be appointed and that the renewal fee and the new application fee be increased by 30 which would cover the costs of the marshals until May, 2017.

 

Thereafter, having heard the deputations, the Clerk, the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed:-

(i) to the appointment of two taxi marshals on the terms as outlined in the note; and

 

(ii) that the Legal Officer write to the Scottish Government on behalf of the Licensing Committee to ascertain progress on the Social Responsibility Levy which may allow for businesses to contribute towards any charge such as that for the cost of operation of the scheme of taxi marshals.

In the case of Application Nos 1 to 6 and 9, having heard a representative of the Housing Department, the Committee agreed that the applications be granted.

 

In the case of Application No 7, having heard the Clerk, the Committee agreed that this application be considered in the private part of the meeting.

 

In the case of Application No 8, having heard a representative of the Housing Department and a representative on behalf of the applicant, the Committee agreed that the application be granted.

 

In the case of Application Nos 10 and 12, having heard a representative of the Housing Department and a representative on behalf of the applicants and noting that the certificates of compliance had been submitted at point of consideration of the applications, the Committee agreed that the applications be granted.

 

In the case of Application No 11, having heard a representative of the Housing Department and a representative on behalf of the applicant, the Committee agreed that consideration of the application be deferred to the meeting of this Committee to be held on 27th March, 2014 to allow the applicant to submit the completed Certificate of Compliance.

 

In the case of Application No 13, the Committee noted that the objector to this application was not present. The Committee gave consideration to the letter of objection which had been submitted by a member of the public. Thereafter, having heard a representative of the Housing Department, a representative on behalf of the applicant and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted and that a report on the operation of the licence be submitted to the meeting of the Committee to be held on 4th September, 2014.

 

In the case of Application No 14, the Committee noted that a late objection had been submitted relevant to this application. Thereafter, having heard the Legal Officer, the Committee agreed that the objection be submitted for consideration. The Committee gave consideration to the letter of objection which had been submitted by a member of the public relative to this application. Thereafter, having heard from a representative of the Housing Department, a representative of the Chief Constable, a representative on behalf of the applicant and consideration of the advice of the Legal Officer and noting that the Certificate of Compliance had been submitted at point of consideration of the application, the Committee agreed that the application be granted and that a progress report be submitted to the meeting of the Licensing Committee to be held in June, 2014 on the operation of the Licence.

 

In the case of Application Nos 15 to 23, the Committee agreed that consideration of these applications be deferred to a future meeting of the Committee.

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

V HOUSES IN MULTIPLE OCCUPATION

 

(a) HOUSES IN MULTIPLE OCCUPATION - NEW APPLICATION

 

There was submitted an application by Company RS for a Houses in Multiple Occupation Licence. Thereafter, having heard a representative of the Housing Department and the applicant on their own behalf, the Committee agreed that the application be granted and that a report be submitted to a meeting of the Committee to be held in three months' time on the operation of the licence.

 

(b) HOUSES IN MULTIPLE OCCUPATION - VARIATIONS

 

There were submitted three applications for variation for day to day manager to Company RS for three properties as indicated.

 

In the case of the three applications, having heard the representative of the Housing Department, an agent on behalf of the applicant, the applicant on their own behalf and the consideration of the advice of the Legal Officer, the Committee agreed that the applications for variation be granted and that a report be submitted to Committee in three months time on the operation of the licences.

 

VI ANTI-SOCIAL BEHAVIOUR (SCOTLAND) ACT 2004 - REGISTRATION OF CERTAIN LANDLORDS

 

There was submitted a letter of information from the Housing Department relevant to the registration of Mr M P as a landlord.

 

The Committee noted that the licence holder was not present. Thereafter, having heard the Clerk the Committee agreed that consideration of the matter be deferred to the next meeting of this Committee to be held on 27th March, 2014 to allow the licence holder to be present.

 

VII CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) REQUEST FOR VARIATION - TAXI OPERATOR

 

There was submitted a request by Mr J G for a variation of his Taxi Driver's Licence to allow Mr T R to be appointed as day to day manager for his taxi.

 

The Committee gave consideration to the request. Thereafter, having heard the Clerk and the applicant on their own behalf, the Committee agreed that the application be granted for an initial period of six months and that a progress report on the operation of the licence be submitted at a meeting of this Committee in six months' time.

 

(b) TAXI DRIVER'S LICENCE - NEW APPLICATIONS

 

(i) There was submitted an application by Mr P F for a Taxi Driver's Licence.

 

There was submitted a letter of objection from the Chief Constable relevant to this application. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, a representative on behalf of the applicant and consideration of the advice of the Legal Officer, the Committee agreed that a licence for a period of three months be granted once the applicant had submitted their Unique Tax Reference Number and Medical Certificate to the satisfaction of the Licensing Office and that the matter be recalled to the Committee thereafter.

 

(ii) There was submitted an application by Mr G S for a Taxi Driver's Licence.

 

There was submitted a letter of objection from the Chief Constable relevant to this application. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, a representative on behalf of the applicant, the applicant on their own behalf and consideration of a letter of support which had been tabled on behalf of the applicant and the advice of the Legal Officer, the Committee agreed that a licence for a period of six months be granted once the applicant had submitted their Unique Tax Reference Number and Medical Certificate to the satisfaction of the Licensing Office and that the matter be recalled to the Committee thereafter.

 

(iii) There was submitted an application by Mr R U for a Taxi Driver's Licence.

 

There was submitted a letter of objection from the Chief Constable relevant to this application. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that consideration of the application be deferred to the meeting of this Committee to be held on 27th March, 2014 to await the outcome of court proceedings.

 

(c) TAXI DRIVER'S LICENCE - SUSPENSION HEARING

 

(i) Reference was made to Article VII(b)(i) of the minute of meeting of this Committee held on 6th February, 2014, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr M A during the currency of his Taxi Driver's Licence to await submission of a report from OHSAS on the fitness of Mr M A to be the holder of a Taxi Driver's Licence.

 

There was submitted the original letter of information from the Chief Constable relevant to the conduct of Mr M A during the currency of his Taxi Driver's Licence, together with a letter of complaint from the Licensing Office in relation to a conversation a member of staff had had with Mr M A.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard the Clerk, the Committee agreed to adjourn the hearing until the meeting of this Committee to be held on 1st May, 2014 to allow the licence holder to be present and to allow the report from OHSAS to be received.

 

(ii) Reference was made to Article II(a)(i) of the minute of meeting of the Licensing Sub‑Committee held on 18th February, 2014, wherein it was agreed to suspend the Taxi Driver's Licence held by Mr S D with immediate effect and to hold a hearing in due course in relation to the fitness of Mr S D to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr S D during the currency of his Taxi Driver's Licence, together with other letters referred to therein.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

The Committee gave consideration to the content of the letters. Thereafter, having heard the Clerk, an agent on behalf of the licence holder and consideration of the advice of the Legal Officer, the Committee agreed to suspend the Taxi Driver's Licence held by Mr S D for the unexpired portion with immediate effect.

 

(iii) Reference was made to Article II(a)(ii) of the minute of meeting of the Licensing Sub‑Committee held on 18th February, 2014, wherein it was agreed to suspend the Taxi Driver's Licence held by Mr J R with immediate effect and to hold a hearing in due course in relation to the fitness of Mr J R to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr J R during the currency of his Taxi Driver's Licence.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard the Clerk and consideration of the advice of the Legal Officer the Committee agreed to suspend the Taxi Driver's Licence held by Mr J R for the unexpired portion with immediate effect.

(i) Reference was made to Article II(a)(ii) of the minute of meeting of this Sub-Committee held on 27th November, 2013, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr N B during the currency of this Taxi Drivers Licence to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr N B during the currency of his Taxi Drivers Licence.

 

The Sub-Committee noted that the licence holder was not present.

 

Thereafter, having heard from the Clerk, the Sub-Committee agreed to further adjourn the hearing until the meeting of the Committee to be held on 27th March, 2014 to await the outcome of court proceedings.

 

(ii) Reference was made to Article II(b)(ii) of the minute of meeting of the Licensing Sub‑Committee held on 5th December, 2013, wherein it was agreed that a hearing be held in relation to the fitness of Mr J B to be the holder of a Taxi Drivers Licence.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr J B during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the Clerk, the representative on behalf of the licence holder, the licence holder on their own behalf and the representative of the Chief Constable, the Sub-Committee agreed that no further action be taken and that the licence holder be issued with a final written warning as to their future conduct.

 

(iii) Reference was made to Article II(a)(vii) of the minute of meeting of this Sub‑Committee held on 27th November, 2013, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr R McL during the currency of his Taxi Drivers Licence to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr R McL during the currency of his Taxi Drivers Licence.

 

The Sub-Committee noted that the licence holder was not present. Thereafter, having heard the Clerk, the Sub-Committee agreed to further adjourn the hearing until the meeting of this Committee to be held on 27th March, 2014 to await the outcome of court proceedings.

 

(iv) Reference was made to Article II(a)(ix) of the minute of meeting of the Licensing Sub‑Committee held on 27th November, 2013, wherein it was agreed that the hearing in relation to the alleged conduct of Mr G M during the currency of his Taxi Driver's Licence be deferred to allow the licence holder to be present.

 

There was submitted a letter of information from the Environmental Compliance Manager relevant to the alleged conduct of Mr G M during the currency of his Taxi Drivers Licence.

 

The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the Environmental Compliance Manager and consideration of the advice of the Legal Officer, the Sub‑Committee agreed to suspend the Taxi Drivers Licence held by Mr G M until 31st May, 2014, being the unexpired period of the licence.

 

(v) Reference was made to Article VII(d)(viii) of the minute of meeting of the Licensing Committee held on 5th December, 2013, wherein it was agreed to adjourn the hearing in relation to the conduct of Mr J R during the currency of this Taxi Drivers Licence to allow for the licence holder to pay the outstanding monies of the Fixed Penalty Notice and Compensation Order.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr J R during the currency of his Taxi Drivers Licence.

 

The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and the Clerk, the Sub-Committee agreed to further adjourn the hearing until the meeting of this Sub-Committee to be held on 27th March, 2014 to allow the licence holder to be present.

 

(vi) Reference was made to Article VII(d)(vii) of the minute of meeting of the Licensing Committee held on 5th December, 2013, wherein it was agreed that the hearing in relation to the alleged conduct of Mr J R during the currency of his Taxi Driver's Licence be adjourned to allow the licence holder to be present.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr J R during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard from the representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Sub-Committee agreed that no further action be taken and that a final written warning be issued to the licence holder as to their future conduct and that any application for renewal of the licence be submitted then this should be referred to the Sub-Committee for determination.

 

(vii) Reference was made to Article II(a)(xiii) of the minute of meeting of the Licensing Sub‑Committee held on 27th November, 2013, wherein it was agreed to adjourn the hearing in relation to the fitness of Mr S U to be the holder of a Taxi Drivers Licence to await the outcome of court proceedings.

 

The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard from the representative of the Chief Constable, the Sub-Committee agreed that no further action be taken and that should any application for renewal of the licence be submitted, then this should be referred to the Sub-Committee for determination.

 

(viii) Reference was made to Article II(a)(xiv) of the minute of meeting of the Licensing Sub‑Committee held on 27th November, 2013, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr C W during the currency of this Taxi Drivers Licence to allow the licence holder to be present.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr C W during the currency of his Taxi Drivers Licence.

 

The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable, the Sub-Committee agreed to adjourn the hearing to the meeting of the Sub-Committee on 27th June, 2014.

 

(b) TAXI DRIVERS/TAXI OPERATORS LICENCE - SUSPENSION HEARINGS

 

There was submitted a letter of information from Police Scotland relevant to the alleged conduct of Mr S M during the currency of his Taxi Drivers Licence and Taxi Operator's Licence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and the licence holder on their own behalf, the Sub-Committee agreed that the Taxi Drivers Licence held by Mr S M be suspended for three weeks and that should any application for renewal of the licence be submitted, then this should be referred to the Sub‑Committee for determination.

 

(c) TAXI DRIVERS LICENCE - REQUEST FOR SUSPENSION HEARINGS

 

There was submitted a letter of information from the Environmental Compliance Manager relative to the alleged conduct of Mr G G during the currency of his Taxi Drivers Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Environmental Compliance Manager. Thereafter, having considered the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be convened in due course in relation to the fitness of Mr G G to be the holder of a Taxi Drivers Licence.

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr U K to be the holder of a Taxi Operator's Licence and Taxi Driver's Licence.

 

III ANTI-SOCIAL BEHAVIOUR (SCOTLAND) ACT 2004 - REGISTRATION OF CERTAIN LANDLORDS - REQUEST FOR REVOCATION

 

There was submitted a letter of information from the Director of Housing relative to the alleged conduct of Mr M P during the currency of his registration as a landlord.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Director of Housing. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr M P to be registered as a landlord.
