PROPOSAL: CERTIFICATE OF LAWFUL USE FOR CLASS 1 RETAIL USE

There was submitted Agenda Note AN29-2013 making reference to the decision of the Council on 9th November, 2012 under powers delegated to the Director of City Development to refuse a Certificate of Lawful Use for the above proposal. The application was refused because it was considered that the evidence submitted with the application was insufficient to demonstrate that the use of the area, as detailed in the submitted plan, for Class 1 retail use would be lawful.

It was reported that the decision was subsequently appealed and was dismissed.

IV DELEGATED ITEMS

There was submitted Agenda Note AN30-2013 reporting that from 22nd January, 2013 to 21st February, 2013, 40 applications were decided under delegated powers. Six of these applications attracted objections and, of these, four were approved and two were refused.

The Committee noted accordingly.
