I PLANNING APPLICATIONS

 

(a) 10-00334-FULL - 4 THE ESPLANADE, BROUGHTY FERRY - ERECTION OF SINGLE STOREY EXTENSION TO REAR (NORTH ELEVATION OF DWELLINGHOUSE) - FOR PROFESSOR AND MRS BEGG

 

It was reported that a request had been received for a deputation to address the Committee in support of the above application.

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of City Development and, in the circumstances, declined to hear the deputation.

 

(b) 10-00397-FULL - DALNACRAIG AND MAYFIELD SPORTS GROUNDS - FORMATION OF TWO SYNTHETIC TURF PITCHES, ERECTION OF FLOODLIGHTING, INSTALLATION OF DRAINAGE INFRASTRUCTURE AND EXTENSION TO EXISTING CAR PARKING FACILITIES - FOR DUNDEE HIGH SCHOOL

 

Councillors Duncan, Hunter, Ross, McCready and Bailie Scott declared a non-financial interest in this item, the first four by virtue of their appointment as Directors of Dundee Leisure Trust, and Bailie Scott by virtue of being the parent of a child attending Dundee High School. All left the Chamber during its consideration.

 

The Committee acceded to a request which had been received for a deputation to address the Committee in relation to objections to the application.

 

After the deputation had stated its case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, Councillor Lynn, seconded by Councillor Keenan, moved refusal of the application on the grounds that the proposed formation of two all weather sports pitches, erection of 3.0 - 5.0m high fencing, installation of floodlighting at Dalnacraig East and the extension of the existing car parking facilities at Mayfield, will have an adverse impact upon the level of environmental quality afforded to neighbouring residents by virtue of noise disturbance from the use of the all weather pitches, road safety from increased traffic, light pollution from the proposed flood lights and visual amenity due to the appearance of the proposed flood lighting columns and fencing. The proposals are therefore contrary to the requirements of Policy 1 (Vibrant and Sustainable Communities) of the Dundee Local Plan Review 2005. There are no material considerations that would justify laying aside the provisions of the Development Plan to grant planning permission.

 

As an amendment, the Convener, seconded by Councillor Guild, moved approval of the application subject to the conditions recommended by the Director of City Development, with the amendment of Condition 4 to restrict usage to between the hours of 9.00 am and 8.00 pm, Monday to Saturday.

 

On a division, there voted for the motion - Depute Lord Provost Borthwick, Bailies Sawers, Regan and Wright, and Councillors Bowes, Duncan, Fordyce, Lynn, Melville, Roberts, Keenan, Asif, Bidwell, Ferguson, Hay, Macpherson and Dick (17); and for the amendment - the Convener, Lord Provost Letford and Councillor Guild (3) - whereupon the motion was declared carried.

 

(c) 10-00389-FULL - DOWNFIELD PAVILION ANNEX, CHARLOTTE STREET - INSTALLATION OF TWO SINGLE STOREY TEMPORARY PORTACABIN CHANGING UNITS AND ONE TEMPORARY STORAGE UNIT - FOR PAUL GIBSON, DUNDEE WEST FOOTBALL CLUB

 

Councillor Fordyce declared a non-financial interest in this item by virtue of the fact that her grandson played for Dundee West Football Club, and took no part in the discussion thereof.

 

The Committee acceded to a request which had been received for a deputation to address the Committee in support of the above application.

 

After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, the Committee approved the application subject to the conditions recommended by the Director of City Development.

 

(d) 10-00390-FULL - PARKVIEW CAR SALES, CHARLESTON DRIVE - PROPOSED CONTINUATION OF USE OF YARD FOR USED CAR SALES - FOR PARKVIEW CAR SALES

 

The Committee approved the application subject to the conditions recommended by the Director of City Development.

 

(e) 08-00456-FUL - LAND NORTH OF NURSING HOME, HARESTANE ROAD - ERECTION OF SEVEN DWELLINGHOUSES - FOR ARROWPOINT LTD

 

After considering objections received, the Committee refused the application on the grounds that:-

 

(i) the applicant has failed to demonstrate that the development would not place buildings and persons at flood risk contrary to Environmental Resources Policy 4 of the Dundee and Angus Structure Plan 2001/2016, Policy 76 of the Dundee Local Plan Review 2005 and Government advice set out in SPP 2010. There are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan;

 

(ii) the development fails to comply with Policy 70: Semi-natural Greenspaces of Local Nature Conservation Importance of the Dundee Local Plan Review 2005 as the development will adversely affect the nature conservation qualities of the site and will not meet the objectives of the policy. There are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan;

 

(iii) the development fails to comply with Policy 75: Sustainable Drainage Systems of the Dundee Local Plan Review 2005 as no satisfactory SUDS has been provided and there are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan;

 

(iv) the development fails to comply with Policy 66B: Protection of other Open Space as the proposal involves the loss of open space in circumstances where there is no approved strategy or masterplan for the development of this site. There are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan; and

 

(v) the development fails to comply with Policy 4: Design of New Housing as the proposal would provide inadequate usable private garden ground for all of the houses. There are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan.

 

(f) THE COUNTING HOUSE, 67-71 REFORM STREET - PROPOSED PAVEMENT CAFE - FOR MR CHRIS FERRIDAY

 

This item was withdrawn.

 

(g) 10-00310-FULL - 76A VICTORIA ROAD - CHANGE OF USE FROM FLAT TO FOUR BEDROOM HOUSE OF MULTIPLE OCCUPATION - FOR M & A DUNDEE LTD

 

Councillor Asif declared a financial interest in this item by virtue of being a Director of the Company, and took no part in the discussion thereof.

 

The Committee approved the application subject to the conditions recommended by the Director of City Development.

 

(h) 10-00337-FULL - 14 GLENCONNOR DRIVE - FORMATION OF DRIVEWAY - FOR JOHN BOAN

 

After considering objections received, the Committee approved the application subject to the conditions recommended by the Director of City Development.

 

II DELEGATED APPLICATIONS

 

There was submitted Agenda Note AN95-2010 advising that from 22nd May, 2010 to 21st July, 2010, 97 applications were decided under delegated powers. 15 of these had attracted objections, 14 of which were approved with one being refused.
