The minute of meeting of this Committee of 4th December, 2008 was held as read.

 

Unless marked thus * all items stand delegated.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

I CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI DRIVER AND PRIVATE HIRE LICENCE - SUSPENSION HEARING

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr D G during the currency of his Taxi Driver and Private Hire Licences.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, the Committee gave consideration to the content of the letter and having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, agreed that the suspension of the Taxi Driver's Licence continue until the meeting of the Licensing Committee to be held in March 2009 and that no further action be taken in relation to the Private Hire Licence in the intervening period.

 

(b) TAXI DRIVER AND TAXI OPERATOR'S LICENCE - SUSPENSION HEARING

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr P R during the currency of his Taxi Driver and Taxi Operator's Licences.

 

Thereafter, the Committee gave consideration to the content of the letter and having heard the representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, agreed that the suspension of the Taxi Driver's Licence continue until the meeting of the Licensing Committee to be held in March 2009 and that no further action be taken in relation to the Taxi Operator's Licence in the intervening period.

 

(c) TAXI DRIVER'S LICENCE - SUSPENSION HEARING

 

There was submitted a letter of information from the Fraud and Liaison Supervisor of the Finance Department of Dundee City Council relevant to the alleged conduct of Mr K A during the currency of his Taxi Driver's Licence.

 

Thereafter, the Committee gave consideration to the content of the letter and having heard the Fraud and Liaison Supervisor, the agent on behalf of the licence holder and consideration of three letters of support which had been tabled on behalf of the licence holder and consideration of the advice of the Legal Officer and the Clerk, agreed that further consideration of the matter be adjourned to the meeting of the Licensing Committee to be held in March 2009 and that no further action be taken in relation to the Taxi Driver's Licence in the intervening period.
