In the case of Application No. 1, the Committee agreed that the application be granted.

 

In the case of Application Nos. 2, 3 and 4, the Committee after hearing a representative on behalf of the applicant, agreed that the applications be granted subject to conditions.

 

In the case of Application No. 5, Councillors Fordyce and Grant declared an interest and took no part in the discussion, thereafter, the Committee after hearing an officer of the Environmental and Consumer Protection Department, agreed that the application be granted for a period of three months in order to comply with the conditions stipulated by Planning and Building Control.

 

In the case of Application No. 6, having been advised that the objector was not present, the Committee after hearing the applicant on his own behalf and officers from Environmental and Consumer Protection and Tayside Police agreed that the application be granted subject to conditions.

 

The Committee agreed to defer consideration of the remaining applications.

In the case of Applications Nos. 21 and 22, the Committee noted that they had been withdrawn.

 

In the case of Applications Nos. 23, 24 and 25, the Committee noted that the applicants had failed to pass the Street Knowledge Test within the prescribed period and agreed to refuse the applications.

 

There being no objections the Committee agreed that the remaining applications be granted.

 

(e) TAXI LICENCE - NEW APPLICATIONS

The Committee, after noting that the objections received from Dundee Taxi Association had been withdrawn, agreed that the applications be granted.

 

PART II - CONFIDENTIAL ITEMS

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted items of business on the grounds that this would involve the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part 1 of Schedule 7A to the above Act.

 

II CIVIC GOVERNMENT (SCOTLAND) ACT, 1982

 

(a) PUBLIC ENTERTAINMENT LICENCE - NEW APPLICATION

 

There was submitted an application by KK for a Public Entertainment Licence

 

The Committee noted that the representation by the Chief Constable had been withdrawn and agreed that this item be deferred to allow the applicant to attend.

 

(b) WINDOW CLEANER'S LICENCE - NEW APPLICATION

 

There was submitted an application by Mr JC for a Window Cleaner's Licence.

 

The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application. Part of the representation referred to convictions which were spent in terms of the Rehabilitation of Offenders Act, and after hearing the Chief Constable's representative as to their age and nature, the Committee agreed that these be considered in the interests of justice.

 

Thereafter, after hearing the applicant on his own behalf, the Committee agreed that the application be granted.

 

(c) PRIVATE HIRE OPERATOR'S LICENCE - NEW APPLICATION

 

There was submitted an application by Mr JK for a Private Hire Operator's Licence.

 

The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application. Part of the representation referred to convictions which were spent in terms of the Rehabilitation of Offenders Act, and after hearing the Chief Constable's representative as to their age and nature, the Committee agreed that these be considered in the interests of justice.

 

Thereafter, after hearing the applicant on his own behalf, the Committee agreed that consideration of this item be deferred in order to ascertain if a suspension hearing had been convened regarding a previous conviction.

 

(d) TAXI DRIVER'S LICENCE - NEW APPLICATIONS

 

There was submitted an application by Mr JB for a Taxi Driver's Licence.

 

It was noted that the applicant was not present and after consideration of an objection from the Chief Constable, the Committee agreed that the application be refused.

 

There was submitted an application by Mr RF for a Taxi Driver's Licence.

 

The Committee after hearing the applicant on his own behalf and consideration of information from a representative of Tayside Police, agreed that consideration of this item be deferred to allow the applicant to secure legal representation.

 

(e) TAXI DRIVER - SUSPENSION HEARING

 

There was submitted a letter of complaint by the Chief Constable relative to the conduct of Mr BW during the currency of his Taxi Driver's Licence.

 

After being informed that the licence holder was not present, the Committee agreed to defer consideration of this item to a future meeting.
