II APPOINTMENT OF LORD PROVOST (CONVENER OF THE COUNCIL)
The Returning Officer called for nominations for the appointment to the Office of Lord Provost.
Councillor Guild, seconded by Councillor Duncan, moved that Councillor Barrie be appointed.
Councillor Keenan, seconded by Councillor Macpherson, moved that Councillor Letford be appointed.

III COMMITTEE STRUCTURE (INCLUDING STANDING ORDERS AND SCHEMES OF ADMINISTRATION)
There was submitted Report No 291-2007 by the Chief Executive making proposals to streamline the Council's Committee Structure, Standing Orders, Delegated Powers, Financial Regulations and Tendering Procedures to support the delivery of the Council's Corporate Plan.
The Committee approved the proposals included in the report subject to the following amendments:-
(i) two teaching staff members be appointed to the Education Committee as per the previous arrangements; and
(ii) membership of the Licensing Committee, Licensing Board and Ad Hoc Sub-Committees be as follows:-

VII MEMBERSHIP OF LICENSING COMMITTEE
There was submitted Agenda Note AN138-2007 whereby reference was made to Article III above.
It was agreed that as far as the Licensing Committee membership was concerned, in the event of a member of the Licensing Committee being unable to attend a meeting, it would be the responsibility of the group concerned to arrange for a trained substitute to attend.
VIII APPOINTMENT OF EX-OFFICIO JUSTICES OF THE PEACE
There was submitted Agenda Note AN139-2007 whereby it was noted that the power for Local Authorities to appoint ex-officio Justices of the Peace would cease in December 2007 and at that time, all elected members, subject to appropriate training, would be given powers to carry out signing duties of a non-judicial nature.
It was agreed that Lord Provost Letford, Councillors Wright, Dick, Barrie and Roberts, as former ex-officio Justices of the Peace, continue in this role, and that Councillors Wallace and Keenan also be appointed.

X APPOINTMENTS TO OUTSIDE BODIES
Councillor Keenan, seconded by Councillor Macpherson moved that membership of outside bodies be allocated as detailed in Appendix I to this minute and that as far as Joint Boards were concerned nominations for Chairman, Convener and Vice-Conveners be as detailed in Appendix II to this minute and that as far as COSLA was concerned, the nomination for President be Cormack McChord, Stirling Council.
Councillor Guild, seconded by Councillor Duncan, moved that membership of outside bodies be allocated as detailed in Appendix III to this minute and that as far as COSLA was concerned, the nomination for President be Rob Murray, Angus Council.

Members noted that bodies listed in Appendix I numbered 1-10 comprised entirely of local authority members and that members may therefore take part and vote on any item concerning these bodies when they appeared on agendas at Council/Committee meetings, that the bodies numbered 11-26 had been granted dispensations by the Standards Commission and therefore generally Councillors appointed to these bodies by the Council may speak and vote on items concerning these bodies when they appeared on agendas at Council/Committee meetings, and that the bodies numbered 27-60 had not been granted dispensations by the Standards Commission. Councillors appointed to these bodies would have to declare an interest and might not be able to speak or vote on matters relating to those bodies which came before the Council/Committee meetings.
XI CHURCH/RELIGIOUS REPRESENTATIVES ON THE EDUCATION COMMITTEE
There was submitted Agenda Note AN140-2007, whereby reference was made to Article III above.
It was agreed that it be remitted to the Depute Chief Executive (Support Services) to make the necessary arrangements to seek nominations for the appointments in the usual way and that the previous church/religious and teaching staff representatives continue in their present capacity for a period of up to six months to allow arrangements to be made for representatives to be appointed to the Committee.
It was noted that the appointees would need to comply with the Code of Conduct in accordance with the Standards Commission's Guidance on this matter.
XII EDUCATION APPEAL COMMITTEE (EXCLUSIONS FROM SCHOOL AND PLACING REQUESTS FOR SCHOOLS)
There was submitted Agenda Note AN141-2007, whereby it was noted that the Education Appeal Committee which deals with appeals relative to exclusion from school and refusal of placing requests for schools, required to be set up under the Education (Scotland) Act 1980.
It was reported that, at present, there were three Chairpersons for the Appeal Committee appointed by the Education Committee, Mrs Mary Reid, Mrs Mary Hanlon and Mr Gavin Smith who chair the Committee by rotation. All had intimated that they were prepared to carry on in this role for a further period.
In order to allow continuity for appeal hearings, especially during the period May/June when Primary 1 and Secondary 1 placing appeals are heard, it was agreed that Mrs Reid, Mrs Hanlon and Mr Smith be re-appointed, along with the Convener of Education or nominee and that the Appeal Committee comprise the Convener of Education or his nominee, together with an independent Chairperson and one School Board Parent representative. (Parent Council representative from August 2007).
XIII COMPLAINTS REVIEW COMMITTEE (SOCIAL WORK)
There was submitted Agenda Note AN142-2007, advising that the Council required to set up a Complaints Review Committee, the remit of which would be to review on the request of the complainant any response or action to be taken by the authority.
The Committee previously comprised two elected members and one non-elected member chair.
It was agreed that Bailie Wright and Councillor Fordyce be appointed and that it be remitted to the Director of Social Work to ascertain whether the existing non-elected member (chair) wished to continue.
XIV TRAINING FOR MEMBERS
Members noted the content of the guidance notes which had been previously issued.
XV MEMBERS SALARIES, PENSIONS AND EXPENSES
There was submitted Report No 290-2007 by the Depute Chief Executive (Finance) seeking the Council's approval to a Scheme of Salaries and Expenses for elected members, with the scheme to be effective from 4th May, 2007.
The Council agreed:-
(i) the contents of the report, including the salaries proposals circulated at the meeting and detailed in Appendix IV to this minute;
(ii) that a Scheme of Salaries and Expenses based on this Appendix be prepared and issued to all elected members; and
(iii) to pay members' salaries and expenses on a calendar monthly basis, in accordance with the Regulations.
