Licensing Sub-committee - 07/09/2006

At a MEETING of the LICENSING SUB-COMMITTEE held at Dundee on 7th September, 2006.

The Sub-Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

I CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI OPERATOR LICENCE AND TAXI DRIVER LICENCE

 

There was submitted a letter of information from the Chief Constable relative to the alleged conduct of licence holder Mr J C during the currency of his Taxi Operator and Taxi Driver's licences.

 

The Sub-Committee, gave consideration to the letter and after hearing a representative of the Chief Constable, agreed that a suspension hearing be convened in relation to the Taxi Operator and Taxi Driver's licences held by Mr J C.

 

(b) TAXI DRIVER'S LICENCE

 

(i) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of licence holder Mr P K during the currency of his Taxi Driver's licence.

 

The Sub-Committee, gave consideration to the letter of information and after having heard a representative of the Chief Constable, agreed that a suspension hearing be convened in relation to the Taxi Driver's licence held by Mr P K.

 

Councillor Fordyce declared a non financial interest in the following matter by virtue of the licence holder being known to her in a personal capacity and withdrew from the Chamber prior to its consideration whereupon her place was taken by Bailie Mackie.

 

(ii) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr H W during the currency of his Taxi Driver's licence.

 

The Sub-Committee, gave consideration to the letter of information and after having heard a representative of the Chief Constable, agreed that a suspension hearing be convened in relation to the Taxi Driver's licence held by Mr H W.

 

Prior to consideration of the following item Councillor Fordyce re-entered the Chamber, whereupon Bailie Mackie withdrew from the meeting.

 

(iii) There was submitted a letter of information relative to the alleged conduct of Mr D M during the currency of his Taxi Driver's licence.

 

The Sub-Committee gave consideration to the letter of information and after having heard a representative of the Chief Constable, agreed that a suspension hearing be convened in relation to the Taxi Driver's licence held by Mr D M.

 

(iv) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr J D during the currency of his Taxi Driver's licence.

 

The Sub-Committee gave consideration to the letter and after having heard a representative of the Chief Constable, agreed that a suspension hearing be convened in relation to the Taxi Driver's licence held by Mr J D.

 

(v) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr B R during the currency of his Taxi Driver licence.

 

The Committee gave consideration to the letter of information which had been submitted by the Chief Constable. Part of the letter referred to convictions which were spent in terms of the Rehabilitation of Offenders Act and after hearing their age and nature the Committee agreed that they be considered since justice could not otherwise be done.

 

Thereafter, the Sub-Committee, having heard a representative of the Chief Constable, agreed that a suspension hearing be convened in relation to the Taxi Driver's licence held by Mr B R.
