The minute of meeting of this Committee of 15th August 2005 was held as read.

I QUALITY OF LIFE - HOUSING FOOTPATH REPAIRS

 

There was submitted Report No 460-2005 by the Director of Planning and Transportation and the Director of Housing updating the Committee on progress with the citywide repair programme to Housing footpaths funded from the Quality of Life Fund.

 

The Committee agreed to note the contents of the report.

 

II HOUSES IN MULTIPLE OCCUPANCY - SUPPLEMENTARY PLANNING GUIDANCE

 

There was submitted Report No 449-2005 by the Director of Planning and Transportation giving background to the control of Houses in Multiple Occupation through both planning and licensing regimes and seeking approval for draft Supplementary Planning Guidance Planning Policies for controlling the concentration of HMOs and preventing multiple occupancy of new housing in certain parts of the city.

 

The Committee agreed to:-

 

(i) the publication of the proposed Supplementary Planning Guidance set out in Appendix 1 of the report for consultation purposes; and

 

(ii) remit the Director of Planning and Transportation to report back on the results of the exercise within six months with any proposed modifications with a view to adopting the Guidance as a material consideration for planning applications.

 

III MODERNISING THE PLANNING SYSTEM - WHITE PAPER BY THE SCOTTISH EXECUTIVE

 

There was submitted Report No 504-2005 by the Director of Planning and Transportation seeking to review the White Paper "Modernising the Planning System" and confirm the Council's response to the Scottish Executive.

The Committee approved the comments and agreed to forward them to the Scottish Executive in response to its consultation document.

 

IV ROAD SAFETY PROGRESS REPORT

 

There was submitted Report No 520-2005 by the Director of Planning and Transportation seeking to inform the Committee of the progress made in reducing road accident casualties in Dundee.

 

The Committee agreed to note the progress made in reducing road accident casualties.

 

V ROAD SAFETY SCHEMES - IMPLEMENTATION 2005-2006

 

There was submitted Report No 521-2005 by the Director of Planning and Transportation advising the Committee of all the locations in the city where road safety intervention measures had been requested from various sources and seeking Committee approval for a prioritised programme of road safety initiatives and pedestrian facilities in 2005-2006.

 

The Committee agreed:-

 

(i) to approve the implementation of the Road Safety Schemes set out in Appendix A to the report; and

 

(ii) that engineering measures required as a result of prioritisation would be awarded to Tayside Contracts under the agreed Schedule of Rates.

 

VI WINTER MAINTENANCE POLICY AND LEVEL OF SERVICE 2005/2006

 

There was submitted Report No 525-2005 by the Director of Planning and Transportation seeking to explain the Winter maintenance operations and seeking Committee approval for the proposed Winter Maintenance Policy and level of service for Winter 2005/2006.

 

The Committee approved the policy and level for service for Winter 2005/2006 as outlined in the report.

 

VII ROAD SAFETY AUDIT PROCEDURES

 

There was submitted Agenda Note AN346-2005 seeking approval for the adoption of a "Road Safety Audit Procedures" document to ensure that all new roads and alterations to existing roads in Dundee continued to be designed with safety in mind.

 

The Committee approved the document.

 

VIII NEW ROADS

 

There was submitted Agenda Note AN347-2005 detailing the undernoted application for road construction consent.

 

The Committee approved the application, subject to conditions which had been agreed with the applicant:-

It was further agreed that on satisfactory completion of these roads and, if so requested by the applicant, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

IX WHITFIELD MASTERPLAN - ABERLADY DRAFT SITE DEVELOPMENT BRIEF

 

There was submitted Agenda Note AN350-2005 whereby reference was made to Article XII of the minute of meeting of this Committee of 20th June 2005 wherein the Committee approved the above mentioned Draft Site Planning Brief for purposes of consultation, and remitted the Director of Planning and Transportation to consult with the local community and interested parties on the terms and content of the Draft Site Planning Brief.

 

It was reported that in co-operation with the Communities and Housing Departments, a consultation event had been held and most residents had been in favour of the housing proposal. A significant number would only support housing provided by the private sector. There was mixed reaction to the proposed small commercial provision. Whilst most saw this as an attraction to loitering youths and other anti social behaviour, others saw the need for some community facility and others saw a need in the longer term for some modest provision of commercial facility.

 

Given the dynamics of change in the area which was likely to impact on youth behaviour and demand for commercial facilities it was recommended that the site be retained for future community use but specific reference to cafi/restaurant be deleted.

 

The Committee agreed that the above comments be noted and that the Draft Brief be approved as supplementary planning guidance to the Dundee Local Plan Review 2005 and as a material consideration in the determination of planning applications for the site.

 

X DUNDEE CITY COUNCIL (HILLTOWN TERRACE AREA, DUNDEE) (OFF-STREET CAR PARKS FOR DISABLED BADGE HOLDERS) ORDER 2005

 

There was submitted Agenda Note AN351-2005 whereby reference was made to Article VI of the minute of meeting of this Committee of 20th June 2005 instructing and authorising the preparation of an Order to provide a car parking facility for disabled badge holders in an area of high density housing.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised

 

XI DUNDEE CITY COUNCIL (FORTHILL ROAD AND FINTRY PLACE, BROUGHTY FERRY, DUNDEE) (ONE-WAY TRAFFIC AND WAITINGRESTRICTIONS) ORDER 2005

 

There was submitted Agenda Note AN352-2005 whereby reference was made to Article VII of the minute of meeting of this Committee of 20th June 2005 instructing and authorising the preparation of an Order to improve traffic circulation and create a dropping off point for children in the new road layout.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

XII A92 DUNDEE - ARBROATH ROAD DUAL CARRIAGEWAY ASSOCIATED TRAFFIC REGULATIONS ORDER

 

There was submitted Agenda Note AN356-2005 whereby reference was made to Article III of the minute of meeting of this Committee of 16th May 2005 which recommended the preparation of the above Traffic Regulation Order.

In view of the timescales involved, it was reported that this matter had been approved by the Director of Planning and Transportation in consultation with the Convener and spokespersons from the other groups.

 

The Committee noted accordingly.

 

XIII TENDERS RECEIVED

 

There was submitted Report No 527-2005 by the City Engineer detailing tenders received in respect of the Whitfield Surface Water Management Scheme and requesting a decision on acceptance thereof.

 

The Committee agreed to accept the lowest tender by Torith Limited amounting to 569,027 to which required to be added allowances for professional services amounting to 209,974, making a total expenditure of 779,001.
