I ILLEGAL MONEY LENDING DEPARTMENT OF TRADE AND INDUSTRY NATIONAL INITIATIVE
There was submitted Report No 768-2004 by the Head of Environmental Health and Trading Standards on the launch of a Scotland-wide illegal money lending team and seeking approval of the operation of the team in Dundee when appropriate.
The Committee agreed:-
(i)that the content of the report be noted; and
(ii)that authorisation be given to the Head of Environmental Health and Trading Standards to use delegate powers to authorise named officers of Glasgow City Council to undertake enforcement duties under the Consumer Credit Act, 1974.
IIDEPARTMENT OF TRADE AND INDUSTRY CONSULTATION RESPONSE DOORSTEP SELLING AND COLD CALLING
There was submitted Report No 770-2004 by the Head of Environmental Health and Trading Standards seeking approval for a response to the Department of Trade and Industry on their recent consultation 'Doorstep Selling and Cold Calling', and seeking further approval of other issues in connection with doorstep sales.
The Committee agreed:-
(i)that the response from Dundee City Council be approved;
(ii)that the work currently being done by Trading Standards Officers in connection with a local good trader scheme be noted; and
(iii)that it be recommended to the Scottish Executive that doorstep selling be prescribed as an activity which could be licensed under the Civic Government (Scotland) Act, 1982.
III ANTI-SOCIAL BEHAVIOUR ETC (SCOTLAND) ACT, 2004 SALE OF SPRAY PAINTS
There was submitted Report No 769-2004 by the Head of Environmental Health and Trading Standards on powers granted to local authorities under the Anti-Social Behaviour etc (Scotland) Act, 2004 and to request that Trading Standards Officers be authorised to undertake enforcement duties covering the sale of spray paints to children.
The Committee agreed:-
(i)that the content of the report be noted;
(ii)that Trading Standards Officers or other appropriate Officers be authorised to undertake enforcement duties for the purposes of the Anti-Social Behaviour etc (Scotland) Act, 2004 in relation to the sale of spray paints; and
(iii)that the Scheme of Delegation be amended accordingly.
IV PURCHASE OF COLLECTION VEHICLE FOR RECYCLATES
On a reference to Article II of the minute of meeting of 16th February, 2004, there was submitted Report No 780-2004 by the Head of Waste Management seeking approval for the purchase of one recycling vehicle for the collection of compostible material for use within the Waste Management Department.
The Committee agreed that the offer from Faun Municipal Vehicles Ltd, amounting to 126,169.00, for the purchase of a compost recycling vehicle, be accepted.
V LIQUEFIED PETROLEUM GAS METERING SYSTEMS RESULTS OF PROJECTS
There was submitted Agenda Note AN435-2004 on the completion of a national project, led and managed by Dundee City Council Trading Standards Service, to assess the accuracy of liquefied petroleum gas metering systems in use in Scotland.
The Committee noted the content of the agenda note.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act, 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that this would involve the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part 1 of Schedule 7(A) to the above Act.
VICIVIC GOVERNMENT (SCOTLAND) ACT, 1982 SECTION 87(1) BUILDINGS IN NEED OF REPAIR
There was submitted Agenda Note AN436-2004 reporting that Notices had been served on the owners of various properties requiring works to be carried out.
The Committee agreed that the Head of Environmental Health and Trading Standards be authorised to carry out the works should the owners not comply within the time period allowed in the Notices.
VII CIVIC GOVERNMENT (SCOTLAND) ACT, 1982 SECTION 90 LIGHTING OF COMMON STAIRS
There was submitted Agenda Note AN437-2004 reporting that Notices had been served on the owners of various properties requiring works to be carried out.
The Committee agreed that the Head of Environmental Health and Trading Standards be authorised to carry out the work should the owners not comply within the time period allowed in the Notices.
