II PROPOSED AMENDMENT TO CRITERIA USED TO PRIORITISE THE LIST OF UNADOPTEDFOOTWAYS
There was submitted Report No 39-2004 by the Director of Planning and Transportation regarding a proposal for the use of an additional criterion, namely the age of the footway/footpath, when prioritising the List of Unadopted Footways/Footpaths.
The Convener, seconded by Councillor Hind, moved approval of the recommendation that the age of adjacent housing in a street should be used to determine the age of the unadopted footway/footpath and that this additional criterion will be used in future years, commencing 2004/2005.
As an amendment, Councillor Don, seconded by Councillor Duncan, moved that the Committee does not adopt the recommendation to the report but, instead adopts the following additional criteria for future years, commencing 2004/2005 -

On a division, there voted for the motion the Convener, Lord Provost Letford, Bailies Farquhar, Wright, Powrie and Mackie, and Councillors Shimi, Keenan, Regan, Sturrock, Hind, Morrow, Dick, Wallace, Webster and Scott (16); and for the amendment - Bailies Corrigan and Borthwick and Councillors Don, Duncan, Beattie, Andrew Dawson, Sawers, FitzPatrick, Roberts, Barrie, Will Dawson and Fordyce (12); whereupon the motion was declared carried.
III QUALITY OF LIFE - ADOPTED FOOTPATH REPAIRS
There was submitted Report No 316-2004 by the Director of Planning and Transportation advising the Committee of the proposed repair programme for Quality of Life adopted footways in 2004/05 and 2005/06 to be funded through the Quality for Life Fund and seeking authority to commence the proposed repair programme.
The Committee agreed to:-
(a)note the contents of this report and agree the prioritisation of footway repairs in accordance with Appendices 1 and 2 to the report;
(b)authorise the City Engineer to issue orders for carrying out this work based on the Unit Rate Contract for minor roadworks; and
(c)authorise the City Engineer to promote schemes based on priority ratings in the event of unforeseen slippage to the programme.
IV MENZIESHILL CONTROLLED PARKING ZONE - DICKSON AVENUE AREA - VARIATION OFWAITING RESTRICTIONS
There was submitted Report No 322-2004 by the Director of Planning and Transportation considering the effects of the Residents' Parking Scheme in Menzieshill and seeking to amend it in light of experience and comments received as stated at its time of introduction.
The Committee approved the preparation of a Traffic Regulation Order to vary the Menzieshill Controlled Parking Zone and to introduce waiting restrictions in that length of Dickson Avenue outwith the zone in accordance with the terms of the report, subject to it being remitted to the Director of Planning and Transportation to give further consideration to the matter of charges for visitors, as detailed in paragraph 6.4 of the report, and to report back to Committee in the near future.
V GRAY STREET, BROUGHTY FERRY - WAITING RESTRICTIONS
There was submitted Report No 333-2004 by the Director of Planning and Transportation regarding the need to improve safety in Gray Street, Broughty Ferry in the vicinity of the railway level crossing.
The Committee approved the preparation of a Traffic Regulation Order to vary the waiting restrictions in Gray Street between Queen Street and Brook Street to reduce the risk of traffic stopping on the level crossing.
VI DUNDEE AREA WAITING RESTRICTIONS VARIATION
There was submitted Report No 334-2004 by the Director of Planning and Transportation considering the requests during the last year for additions and alterations to waiting restrictions throughout the City.
The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Orders for Dundee in accordance with the terms of the report.
VII DENS STREET ONE-WAY RESTRICTION
There was submitted Report No 339-2004 by the Director of Planning and Transportation detailing the Traffic Regulation Order required to improve access and egress at Princes Street/King Street.
The Committee approved the preparation of a Traffic Regulation Order to reverse the one-way direction of traffic flow in Dens Street from southbound to northbound.
VIII DUNDEE CITY COUNCIL (BELL STREET, DUNDEE) (PROHIBITION OF DRIVING) ORDER 2004
There was submitted Agenda Note AN222-2004 making reference to Article XI of the minute of meeting of this Committee of 26th January 2004 instructing and authorising the preparation of an Order to improve pedestrian safety in the vicinity of a school and University by removing through traffic.
It was reported that the proposed Order had been duly drafted and during the statutory consultation period no adverse comments received.
The Committee therefore authorised formal publication of the Order as drafted.
IX DUNDEE CITY COUNCIL (CENTRAL AREA, DUNDEE) (VARIATION OF PAY AND DISPLAYTARIFFS) ORDER 2004
There was submitted Agenda Note AN223-2004 making reference to Article VI of the minute of meeting of this Committee of 23rd February 2004 instructing and authorising the preparation of an Order to relax the time limits for pay and display spaces on the periphery of the Central Area where there were a few commercial properties requiring a higher turnover.
It was reported that the proposed Order had been duly drafted and during the statutory consultation period no adverse comments received.
The Committee therefore authorised formal publication of the Order as drafted.
X DUNDEE CITY COUNCIL (WHITEHALL STREET, DUNDEE) (BUS SHELTER PROVISION)(VARIATION OF WAITING RESTRICTIONS) ORDER 2004
There was submitted Agenda Note AN224-2004 making reference to Article III of the minute of meeting of this Committee of 25th August 2003 instructing and authorising the preparation of an Order to improve public transport facilities in the City Centre and to improve servicing facilities for commercial properties within the street.
It was reported that the proposed Order had been duly drafted and as a result of the consultation process the Committee approved a number of changes to the parking layout in the street.
The Order was subsequently advertised and one objection was received from Fisher and Donaldson.
The Committee agreed to make the Order despite the objection.
XI APPLICATIONS FOR ROAD CONSTRUCTION CONSENT
(a) There was submitted Agenda Note AN225-2004 advising that the undernoted applications had been submitted and the Director of Planning and Transportation had recommended that they be approved subject to conditions agreed with the applicants:-

(b) LIST OF PUBLIC ROADS
It was further agreed that, on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.
The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.
XII SALE OF GROUND AT AMBROSE STREET, BROUGHTY FERRY, DUNDEE
There was submitted Agenda Note AN226-2004 relative to the disposal of an area of ground on the west side of Ambrose Street extending to 50 sq m or thereby.
The Committee approved the sale of ground on the terms and conditions detailed in the note.
