I SCOTTISH EXECUTIVE PROPOSALS - "YOUR PLACE, YOUR PLAN" - A WHITE PAPER ONPUBLIC INVOLVEMENT IN PLANNING
There was submitted Report No. 321-2003 by the Director of Planning and Transportation advising the Committee of the Scottish Executive's proposals for strengthening and enhancing public involvement in the land use planning system following the publication of the Consultation Paper "Getting Involved in Planning",
The Committee agreed to note the content of the White Paper.
II NATIONAL AND AREA WASTE PLAN PROGRESS
On a reference to Article IV of the minute of meeting of the Environmental & Consumer Protection Committee of 19th May 2003, there was submitted Report No. 273-2003 by the Acting Director of Environmental & Consumer Protection and Director of Planning & Transportation advising the Committee of progress on both the National Waste Plan for Scotland and the Area Waste Plan for Tayside, and the key next steps in the Area Waste Plan process.
The Committee agreed to:-
(a) note the launch of the National Waste Plan for Scotland.
(b) note that Ministerial endorsement of the Tayside Area Waste Plan had now been obtained.
(c) commend the approved Tayside Area Waste Plan to the Development Quality Committee as a material consideration when determining relevant planning applications; and
(d) remit the Directors of Environmental and Consumer Protection and Planning and Transportation to provide a joint annual report to the Committee on progress in implementing the Area Waste Plan.
III REVIEW AND UPDATE OF DEVELOPMENT BRIEFS
There was submitted Report No. 240-2003 by the Director of Planning & Transportation advising the Committee of the Development Briefs still fully valid, and informing members as to the value of preparing and maintaining such Development Briefs.
The Committee noted the current status of the Planning Briefs as listed in the Appendix to the report and their relevance as a material consideration in dealing with any planning application for the site.
IV SCHOOLS PPP DRAFT SITE PLANNING BRIEFS
There was submitted Report No. 320-2003 by the Director of Planning & Transportation addressing the requirement of the Scottish Ministers, following guidance in their policy statement "Designing Places" as part of the Public Private Partnership Process, that a site planning brief be prepared for each site.
The Committee agreed to:-
(a) approve the generic draft site planning brief detailed in the report;
(b) approve the eleven draft individual site planning briefs for the purposes of consultation;
(c) remit the Director of Planning & Transportation to consult with local communities; and
(d) remit the Director of Planning & Transportation to report back on the results of the consultation exercise within a period of three months.
V TROTTICK SITE DEVELOPMENT BRIEF
There was submitted Agenda Note AN265-2003 making reference to Article III of the minute of meeting of this Committee of 24th February 2003 whereby approval was given to the Director of Planning & Transportation to proceed with external consultations on the draft Trottick Site Development Brief and to report back to Committee on the completion of the consultation exercise.
The Committee noted the consultations carried out and the comments received and agreed to approve the Trottick Site Development Brief, and its inclusion as part of the sales particulars for the advertisement of the site for housing development by the Director of Economic Development.
VI CITY CENTRE FACADE ENHANCEMENT GRANT SCHEME AND FACADE ENHANCEMENT GRANT SCHEMES INALBERT STREET AND HILLTOWN - ANNUAL UPDATE - RECOMMENDATIONS FOR 2003/04
There was submitted Report No. 250-2003 by the Director of Planning & Transportation advising the Committee as to the progress being made to date on implementing the Facade Enhancement Grant Schemes, in the City Centre, Albert Street and Hilltown, and the targeted areas for financial year 2003-2004.
The Committee agreed:-
(a) to note the progress being made within the three Facade Enhancement Grant Scheme areas;
(b) to continue the scheme during the financial year 2003-2004;
(c) that due to prior enquiries the following streets be targeted for financial year 2003-2004;
(i) Union Street (specifically, the refurbishment of 21 - 25 Union Street);
(ii) Nethergate; and
(iii) South Tay Street
(d) to extend the targeted area in Hilltown to include the section of Strathmartine Road between Mains Road and the Fiveways Roundabout;
(e) to target sections of Albert Street that had been previously identified; and
(f) that the level of grant support in Albert Street, Hilltown/Strathmartine Road be awarded on the basis of the financial profile of the applicant as follows:- 95% for single traders and 75% for others (property companies, company chains, housing associations, etc.), having noted that generally, no applications would be accepted for public houses in this area, unless they were of a very poor appearance in a prominent area.
VII FACADE ENHANCEMENT GRANT, 127 ALBERT STREET
There was submitted Report No. 311-2003 by the Director of Planning & Transportation advising the Committee of the continuing uptake of facade enhancement grants within Albert Street.

VIII CAMPERDOWN STREET, BROUGHTY FERRY STOPPING UP
There was submitted Report No. 300-2003 by the Director of Planning & Transportation relative to the proposal to stop-up a length of Camperdown Street, Broughty Ferry to remove the pedestrian right of passage between the two parts of Grove Academy.
The Committee approved the preparation of a Stopping-Up Order under the powers of The Roads (Scotland) Act 1984 to stop up that length of Camperdown Street, Broughty Ferry over its frontage of Grove Academy to remove the pedestrian right of passage as detailed in the report having noted that the pedestrian right of passage was no longer necessary and a suitable alternative route was available.
IX DUNDEE CITY COUNCIL (VARIATION OF OFF-STREET CAR PARKS) ORDER 2003
There was submitted Agenda Note AN258-2003 making reference to Article IX of the minute of meeting of this Committee of 24th February 2003 instructing and authorising the preparation of an Order to prevent the abandonment and long-term storage of caravans in the Council's car parks, which had resulted in vandalism as well as the loss of parking spaces for cars.
It was reported that the proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.
The Committee accordingly authorised publication of the Order as drafted.
X CONFIRMATION OF TREE PRESERVATION ORDERS AT 9, 11, 15, 17 AND 19 SILVER BUTTON YARD AND 9CHEVALIERS POND
There was submitted Agenda Note AN259-2003 reporting that on 27th and 28th January 2003 and 5th February 2003, the Council made provisional Tree Preservation Orders on the above mentioned sites to protect 10 mature trees within a recently constructed residential development.
It was reported that after the initial service of these Notices, one of the householders concerned objected. The objection raised was that consent had previously been granted for the removal of one of these trees from their garden ground. The provisional Tree Preservation Order in question was No. 4/2003. The tree in question was tree No. T2. It was therefore sought to propose the modification of Tree Preservation No 4/2003 to this effect by deleting tree T2.
The Committee agreed to authorise the Director of Support Services and the Director of Planning & Transportation to undertake the necessary procedures and confirm the Tree Preservation Orders; subject to the proposed modification of Tree Preservation Order No. 4/2003.
It was further remitted to the Director of Planning and Transportation to further investigate the circumstances of the deletion of T2 from the Tree Preservation Order.

There was submitted Agenda Note AN266-2003 advising that the undernoted applications had been submitted and the Director of Planning & Transportation had recommended that they be approved subject to conditions which had been agreed with the applicants:-

The Committee approved the application and agreed that on satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.
