Personnel Appeals Sub-committee - 07/02/2001

At a MEETING of the PERSONNEL APPEALS SUB-COMMITTEE held at Dundee on 7th February, 2001.

The Sub-Committee resolved under Section 50A(4) of the Local Government (Scotland) Act 1973, that the public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 7(A) of the Act.

 

I LEISURE AND PARKS DEPARTMENT - APPEAL AGAINST DISMISSAL

 

There was submitted an appeal by Mr J H, an employee within the Leisure and Parks Department, against his dismissal for gross misconduct.

 

The Sub-Committee heard the Council's representative and witnesses and thereafter the Appellant's representative and witnesses.

 

After questions had been put and answers given by both parties to each other and to the witnesses and by members of the Sub-Committee and its advisers, the parties withdrew.

 

Thereafter, following careful consideration of all the information, the Sub-Committee found that the grounds of the appeal had not been substantiated and agreed that the appeal be not upheld.

 

Councillor Petrie was not present during the above appeal.

 

II ENVIRONMENTAL AND CONSUMER PROTECTION DEPARTMENT - DISCIPLINARY APPEAL

 

There was submitted an appeal by Messrs M B, AM, G McK and A McG, employees within the Environmental and Consumer Protection Department, against disciplinary action.

 

The Sub-Committee heard the Council's representative and witnesses and thereafter the Appellants' representative and witnesses.

 

After questions had been put and answers given by both parties to each other and to the witnesses and by members of the Sub-Committee and its advisers, the parties withdrew.

 

Thereafter, the Sub-Committee found that the grounds of the appeal had not been substantiated and agreed that the appeal be not upheld.

 

Councillor Scott was not present for the above appeal.
