Licensing & Building Standards

Dundee City Council’s General/Support Services team within the Corporate Services Department are responsible for discharging the local authority's statutory duties which fall under the Licensing Scotland Act 2005.

Building Standards Certificates – Section 50

Where an application for a Premises License has been made - there is requirement for Building Standards input by way of a Building Standards Certificate explained as follows:

  • Under section 50 of the Licensing Scotland Act 2005 an application for a Premises Licence other than a provisional premises licence application must be accompanied by a Building Standards Certificate in respect of the premises;
  • Under section 50 of the Licensing Scotland Act 2005 an application provisional Premises Licence need not be accompanied by a Building Standards Certificate in respect of the premises. However an application for a provisional Premises Licence must be confirmed by the Licensing Board before it can take effect therefore an application for confirmation of a provisional premises licence under section 46 must be accompanied by a Building Standards Certificate in respect of the premises;
  • If premises with an existing 1976 Act Licence/Club Certificate of registration have failed to apply for a premises licence by the appropriate deadline (March, June or October 2008 or January 2009) then grandfather rights will not apply and the application will require to be accompanied by a Section 50 Building Standards Certificate.

Duty to Assess Overprovision – Section 7 (Occupant Capacity)

As part of the operating plan, each premises will be required to give Dundee City Council Licensing Board details of capacity.

At the request of the Corporate Services Department - Building Standards assist in this process by carrying out an occupancy calculation.

The capacity is calculated by reference to the Building Standards Regulations using occupancy load factors.

Existing premises may have the theoretical figure reduced due to physical constraints.

General Licensing Inspections – Public Entertainment etc

The local authority is responsible for general licensing, which covers areas such as venues where public entertainment occurs.

Building Standards provides technical expertise to assess the suitability of premises for their intended use. The scope of venues inspected range from, public houses, fairgrounds, circuses, pop concerts, tented and open air events, etc.
