I DECLARATIONS OF INTEREST

 

Lord Provost Borthwick and Councillor Dawson declared a non-financial interest in Article III by virtue of a family member being a serving Police Officer.

 

II SCOTTISH FIRE AND RESCUE QUARTERLY PERFORMANCE REPORT - 1ST OCTOBER TO 31ST DECEMBER, 2018

 

There was submitted Report No 157-2019 by Area Manager Pryde providing information for the Committee regarding the performance of the Scottish Fire and Rescue Service against the priorities, outcomes and performance indicators detailed within the Local Fire and Rescue Plan for Dundee 2017-2020, to facilitate local scrutiny.

 

The Committee agreed to note, scrutinise and question the content of the report.

 

III DUNDEE CITY POLICING AREA PERFORMANCE RESULTS - 1ST OCTOBER TO 31ST DECEMBER, 2018

 

There was submitted Report No 168-2019 by Chief Superintendent Todd providing information for the Committee regarding the performance of Police Scotland against performance indicators that would facilitate local scrutiny.

 

The Committee agreed to note and scrutinise the operational report, subject to the additional recommendation that the Committee call upon Police Scotland to redesign the Dundee City Local Performance Report. The report should be an easily understood document that showed trends, detection rates and comparators between areas of the city and national trends. The report should include analysis of trends, a narrative explaining action taken by Police Scotland and an account of the measures of detection and crime reduction deployed.

 

IV USE OF REGULATION OF INVESTIGATORY POWERS (SCOTLAND) ACT 2000 AND REGULATION OF INVESTIGATORY POWERS ACT 2000

 

There was submitted Report No 161-2019 by the Executive Director of Corporate Services advising the Committee of the use made by the Council of the powers under the Regulation of Investigatory Powers (Scotland) Act 2000 and the Regulation of Investigatory Powers Act 2000 from 1st April, 2018 to 31st March, 2019, reporting on the Investigatory Powers Commissioners Office Inspection Report on Dundee City Council and making recommendations on an Action Plan to address the recommendations in the Report.

 

The Committee:-

 

(i) noted the uses which the Council had made of powers contained in the Regulation of Investigatory Powers (Scotland) Act 2000 and in related powers contained in the Regulation of Investigatory Powers Act 2000 between 1st April, 2018 and 31st March, 2019;

 

(ii) approved the Councils continued proportionate use of the powers, where necessary, in the areas of crime prevention and detection of preventing disorder, in the interests of public safety and for the purpose of protecting public health. In particular, it was agreed to continue to use the powers to prevent and detect anti-social behaviour; and

 

(iii) noted the Investigatory Powers Commissioners Office Inspection Report on Dundee City Council contained within Appendix 2 to the report and agreed the proposed Action Plan to address the recommendations in the report.

 

V CONSULTATION RESPONSE - SCOTTISH GOVERNMENT - AMENDMENTS TO THE ANIMAL HEALTH AND WELFARE ACT 2006

 

There was submitted Report No 140-2019 by the Executive Director of Neighbourhood Services seeking the Committees approval of the Councils proposed response to the Scottish Governments Consultation on Amendments to the Animal Health and Welfare (Scotland) Act 2006.

 

The Committee approved the response appended to the report at Appendix 1 and remitted the Executive Director of Neighbourhood Services to submit this to the Scottish Government accordingly.

 

VI REVIEW OF ENFORCEMENT AND SAMPLING POLICIES AND OFFICER AUTHORISATION - REGULATORY SERVICES

 

There was submitted Report No 142-2019 by the Executive Director of Neighbourhood Services informing the Committee of the revised Enforcement and Food Sampling Policies, and seeking the Committees approval of the authorisation of officers under Section 93 of the Consumer Rights Act 2015.

 

The Committee agreed to:-

 

(i) approve the content of the report and the revised documents contained in Appendices 1 and 2; and

 

(ii) authorise the Trading Standards Manager to determine an appropriate penalty and authorise Trading Standards Officers to issue Notices of Intent and Final Notices in terms of Chapter 5, Part 3 of and Schedule 10 to the Consumer Rights Act 2015 where it appeared that, on the balance of probabilities, there had been a breach of Section 90 of the Act.
