(b) LATE HOURS CATERING LICENCES POLICY

 

Reference was made to Article II of the minute of meeting of this Committee held on 19th September, 2013, wherein it was agreed that a plan be submitted on the revised City Centre area to be included in the Late Hours Catering Policy.

 

There was submitted a plan on the revised City Centre area. The Committee gave consideration to the content of the plan. Thereafter, having heard the Clerk, a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to adopt the revised area shown on the plan and the Committee further agreed that late hours catering establishments outside the designated Dundee City Centre area would generally be subject to the following limitations on opening hours:-

 

Closure no later than 12 midnight Sunday to Thursday and 1am Friday and Saturday. Seasonal extension to these hours would not normally be granted.

 

(c) LATE HOURS CATERING - NEW APPLICATION

 

Reference was made to Article IV(b) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to defer consideration of the application submitted by Mr Ramsay M El-Nakla to await the outcome of the policy review.

In the case of Application No 1, reference was made to Article IV(c) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to defer consideration of the variation to change the hours to 4am Mondays to Sundays to await the outcome of the policy review.

 

The Committee gave consideration to a letter of information which had been submitted by the Chief Constable relative to this application. The Committee noted that the application for renewal was advertised on 28th June, 2013 and that no objections were received. The Committee noted that the application was outwith policy.

 

Thereafter, having heard an agent on behalf of the applicant, the Committee agreed that the application be granted, subject to the restriction of hours to 3.30am Mondays to Sundays.

 

In the case of Application No 2, reference was made to Article IV(c) of the minute of meeting of this Committee held on 5th September, 2013, wherein the Committee agreed to defer consideration of the variation of change of hours to 3am Fridays and Saturdays and 3.30am during seasonal variations (of liquor premises licences) to await the outcome of the policy review.

 

The Committee noted that the application for renewal was advertised on 20th June, 2013 and no objections had been received.

 

Thereafter, having heard the Clerk and consideration of the advice of the Legal Officer, the Committee agreed that the request for variation be refused and that application for renewal of the licence be granted.

In the case of this application, the Committee gave consideration to a letter of objection which was submitted by the Planning Department relevant to this application. The Committee also gave consideration to a letter of objection which had been tabled by an objector relevant to the application. Thereafter, having heard the Clerk, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted, subject to planning consent being obtained.

In the case of this application, reference was made to Article IV(e) of the minute of meeting of this Committee held on 5th September, 2013, wherein the Committee agreed to defer consideration of the application to allow a competent objection to be considered. The Committee noted that as part of the enquiries made during the renewal process, photographs were also obtained which appeared to show vehicles parked outside the premises and these were submitted. There was a condition attached to the licence requiring all vehicles to be stored on the premises which may not have been complied with.

 

The Committee gave consideration to the documentation submitted, including a letter of support by the licence holders landlord.

 

The Committee noted that the objector to the application was not present. Thereafter, having heard the Clerk and consideration of the documentation submitted, including the letter of objection, tabled on behalf of the objector, and having heard the applicant, a representative on behalf of the applicant, a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to grant the application until May, 2013 and that the application be recalled to the Committee upon renewal and that during the operation of the licence monitoring be undertaken by Police Scotland in relation to the ownership of vehicles which may be parked outside the premises.

(i) TAXI LIAISON GROUP - REQUEST FOR MEMBERSHIP

 

There was submitted an application by the GMB for membership of the Taxi Liaison Group.

 

The Committee gave consideration to the content of the application.

 

Thereafter, having heard the Clerk, a representative of the GMB and noting that the GMB had 56 members of the Taxi Trade, the Committee agreed that the GMB be granted one place on the Taxi Liaison Group.

 

(j) TAXI OPERATOR - NEW APPLICATIONS

 

(i) Reference was made to Article IV(h) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to defer consideration of the application by FMC Scotland Ltd/John Hume for three Taxi Operator's Licences to receive further information as to when the applicant was interviewed by Police Scotland. The Committee noted that the application had been received prior to the Committees decision to limit the number of taxis to 611 and not to grant any further applications.

 

Thereafter, having heard the Clerk, the applicant on their own behalf, a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed that the application be refused.

(ii) Reference was made to the minute of meeting of this Committee held on 25th April, 2013, wherein the applicant was issued with a temporary licence, subject to receipt of their Unique Tax Reference Number. The Committee noted that the Unique Tax Reference Number had now been received to the satisfaction of the Clerk and that, as such, the application had been granted under delegated powers.

In the case of Application No 1, reference was made to Article VIII of the minute of meeting of this Committee held on 5th September, 2013, wherein the Committee agreed to defer consideration of the application to await the Certificate of Compliance being lodged.

 

The Committee noted that the Certificate of Compliance had now been lodged to the satisfaction of the Housing Department. The Committee also noted that a variation application had been made to replace John Cape with Ormidale Properties/Deirdre McKean. Thereafter, having heard a representative of the Housing Department, an agent on behalf of the applicant and a representative of the Chief Constable, the Committee agreed that the application be granted.

 

In the case of Application Nos 2 and 4, the Committee, having heard a representative of the Housing Department, agreed that the applications be granted.

 

In the case of Application No 3, the Committee, having heard a representative of the Housing Department and the applicant on their own behalf, agreed that the application be granted.

 

In the case of Application No 5, the Committee noted that this application had been withdrawn from consideration.

 

In the case of Application Nos 6 to 10, the Committee agreed that consideration of these applications be deferred to a future meeting of the Committee.

In the case of Application No 3, there being no objections, the Committee agreed that the application be granted.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

V CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) REQUEST FOR VARIATION - TAXI OPERATOR

 

There was submitted a request for variation of the Taxi Operators Licence held by Mr M S.

 

The Committee noted that the applicant was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the request for variation, together with letters of support submitted by the applicants General Practitioner. Thereafter, having considered the advice of the Legal Officer, the Committee agreed that consideration of the application be deferred to a future meeting of the Committee to allow the licence holder to be present.

 

(b) TAXI DRIVER'S LICENCE - NEW APPLICATIONS

 

(i) There was submitted an application by Ms R S for a Taxi Drivers Licence.

 

There was submitted a letter of representation from the Chief Constable relevant to this application. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted until the December meeting of the Committee to allow the applicant to submit their Unique Tax Reference Number.

 

(ii) Reference was made to Article IX(c) of the minute of meeting of this Committee held on 5th September 2013, wherein the Committee agreed to defer consideration of the application by Mr J Z for a Taxi Drivers Licence to allow the applicant to be present.

 

The Committee noted that the licence holder was not present. Thereafter, having heard the Clerk, the Committee noted that the application was incompetent.

 

(c) TAXI DRIVERS LICENCE - UPDATE

 

(i) Reference was made to Article IX(d) of the minute of meeting of this Committee held on 27th June, 2013, wherein the Committee agreed to grant the application by Mr M McN for a period of three months.

 

There was submitted the original letter of objection from the Chief Constable relative to this application. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to grant the application and to recall any application for renewal back to the Committee.

 

(ii) Reference was made to Article VII(b) of the minute of meeting of this Committee held on 2nd May, 2013, wherein the Committee agreed to grant the application by Mr W R for a period of three months.

 

There was submitted the original letter of objection from the Chief Constable relative to this application. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to grant the application and to recall any application for renewal back to the Committee.

 

(iii) Reference was made to Article VII(b) of the minute of meeting of this Committee held on 2nd May, 2013, wherein the Committee agreed to grant the application by Mr J S for a period of three months.

 

There was submitted the original letter of objection from the Chief Constable relative to this application. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to grant the application and to recall any application for renewal back to the Committee.

 

(d) TAXI DRIVERS LICENCE - SUSPENSION HEARING

 

(i) Reference was made to Article VIII(d) of the minute of meeting of this Committee held on 7th March, 2013, wherein it was agreed to issue a verbal warning to Mr M A, the holder of a Taxi Driver's Licence and to adjourn the suspension hearing until the meeting of this Committee.

 

There was submitted the original letter of complaint from the Chief Constable.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard the licence holder on their own behalf and the representative of the Chief Constable, the Committee agreed that no further action be taken and to recall any application for renewal back to the Committee.

 

(ii) Reference was made to Article IX(d) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr M A during the currency of his Taxi Driver's Licence to allow the licence holder to be present.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr M A during the currency of his Taxi Drivers Licence.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the Committee agreed that the hearing be adjourned until the meeting of the Committee to be held in December, 2013.

 

(iii) Reference was made to Article III(b) of the minute of meeting of this Committee held on 15th August, 2013, wherein it was agreed to adjourn the hearing to await the outcome of court proceedings.

 

There was submitted letters of information from the Chief Constable relevant to the conduct of Mr M A during the currency of his Taxi Drivers Licence.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence held by Mr M A with immediate effect and that a fresh hearing be held at the meeting of this Committee to be held in December, 2013.

 

(iv) Reference was made to Article IX(d) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to adjourn the hearing to allow the licence holder to attend OHSAS for a medical.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr J B during the currency of his Taxi Drivers Licence. There was also submitted a letter of explanation from OHSAS, together with a report from OHSAS which was tabled.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the documentation. Thereafter, having given consideration to the advice of the Legal Officer, the Committee agreed that the Taxi Drivers Licence held by Mr J B be suspended for the unexpired portion of the licence with immediate effect.

 

(v) Reference was made to Article IX(e) of the minute of meeting of this Committee held on 27th June, 2013, wherein it was agreed recall the suspension of the Taxi Driver's Licence held by Mr A C and hold a fresh hearing at this Committee.

 

There was submitted a letter of information from the Chief Constable.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the Committee agreed that no further action be taken.

 

(vi) Reference was made to Article IX(e) of the minute of meeting of this Committee held on 27th June, 2013, wherein it was agreed to adjourn consideration of the hearing to await the outcome of court proceedings.

 

There was submitted letters of information from the Chief Constable relevant to the alleged conduct of Mr M F during the currency of his Taxi Drivers Licence. There was also submitted a letter of support from the licence holder.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the documentation. Thereafter, having heard a representative of the Chief Constable, the Committee agreed that the hearing be adjourned until the meeting of the Committee to be held in November, 2013.

 

(vii) Reference was made to Article IX(e) of the minute of meeting of this Committee held on 27th June, 2013, wherein it was agreed that a hearing be held in relation to the fitness of Ms S G to be the holder of a Taxi Driver's Licence.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable, the Committee agreed that no further action be taken.

 

(viii) Reference was made to Article III(b) of the minute of meeting of this Committee held on 15th April, 2013, wherein it was agreed to adjourn the hearing to await a report from OHSAS.

 

There was submitted letters of information from the Chief Constable relevant to the alleged conduct of Mr J H during the currency of his Taxi Drivers Licence. There was also submitted a letter of support on behalf of the licence holder. There was also submitted a report from OHSAS.

 

The Committee gave consideration to the content of the documentation. Thereafter, having heard a representative on behalf of the licence holder, a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence held by Mr J H with immediate effect and that a fresh hearing be held at the meeting of this Committee to be held in November, 2013.

 

(ix) Reference was made to Article III(b) of the minute of meeting of this Committee held on 6th June, 2013, wherein it was agreed that a hearing be held in relation to the fitness of Mr G H to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter from the Chief Constable.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard the licence holder on their own behalf and a representative of the Chief Constable, the Committee agreed to issue a written warning.

 

(x) Reference was made to Article III(b) of the minute of meeting of this Committee held on 15th August, 2013, wherein it was agreed to adjourn the hearing to await the outcome of court proceedings and to continue the immediate suspension of the Taxi Driver's Licence held by Mr C M.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr C M during the currency of his Taxi Drivers Licence.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the Committee agreed that the hearing be adjourned until the meeting of the Committee to be held in December, 2013 and to continue the suspension of the Taxi Driver's Licence held by Mr C M with immediate effect.

 

(xi) Reference was made to Article I(c) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed that a hearing be held in relation to the fitness of Mr M M to be the holder of a Taxi Driver's Licence.

 

There was submitted letters of information from the Chief Constable. The Committee gave consideration to the content of the letters. Thereafter, having heard the licence holder on their own behalf and having heard the Clerk, the Committee agreed to issue a final written warning.

 

(xii) Reference was made to Article IX(d) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to adjourn the hearing and to continue the suspension of the Taxi Driver's Licence held by Mr S N.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr S N during the currency of his Taxi Drivers Licence.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence held by Mr S N with immediate effect and that a fresh hearing be held at the meeting of this Committee to be held in December, 2013.

 

(xiii) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 25th July, 2013, wherein it was agreed that a hearing be held in relation to the fitness of Mr W S to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter of information from the Environmental Compliance Manager.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative on behalf of the licence holder, the licence holder on their own behalf and having heard the Environmental Compliance Manager, the Committee agreed to issue a verbal warning.

 

(e) TAXI DRIVER'S/TAXI OPERATOR'S LICENCE - SUSPENSION HEARINGS

 

(i) Reference was made to Article IX(e) of the minute of meeting of this Committee held on 5th September, 2013, wherein it was agreed to suspend the Taxi Driver's Licence held by Mr T F with immediate effect and hold a hearing.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr T F during the currency of his Taxi Driver and Taxi Operators Licences.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable, a representative of the licence holder, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence held by Mr T F with immediate effect and that a fresh hearing be convened at the meeting of the Licensing Committee to be held in December, 2013 and that no further action be taken in relation to the Taxi Operators Licence held by Mr T F in the intervening period.

The Sub-Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

II CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI DRIVER'S LICENCE - REQUEST FOR HEARINGS

 

(i) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Ms H C during the currency of her Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Ms H C to be the holder of a Taxi Drivers Licence.

 

(ii) There was submitted a letter of information from the Environmental Compliance Manager relative to the alleged conduct of Mr G M during the currency of his Taxi Drivers Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Environmental Compliance Manager. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr G M to be the holder of a Taxi Drivers Licence.

 

(iii) There was submitted a letter of information from the Environmental Compliance Manager relative to the alleged conduct of Mr D F during the currency of his Taxi Drivers licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Environmental Compliance Manager. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr D F to be the holder of a Taxi Drivers Licence.

 

(iv) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr S N during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr S N to be the holder of a Taxi Drivers Licence.

 

(v) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr M A during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr M A to be the holder of a Taxi Drivers Licence.

 

(vi) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr R R during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr R R to be the holder of a Taxi Drivers Licence.

 

(vii) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Ms S G during the currency of her Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Ms S G to be the holder of a Taxi Drivers Licence.

 

(viii) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr N B during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr N B to be the holder of a Taxi Drivers Licence.

 

(ix) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr G B during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr G B to be the holder of a Taxi Drivers Licence.

 

(b) TAXI DRIVER'S AND OPERATORS LICENCES - REQUEST FOR HEARINGS

 

(i) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr M A during the currency of his Taxi Driver's and Operator's Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr M A to be the holder of a Taxi Drivers and Operators Licence.

 

(ii) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr C W during the currency of his Taxi Driver's and Operators Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr C W to be the holder of a Taxi Drivers and Taxi Operators Licence.

 

III INDISCRIMINATE PARKING IN NETHERGATE

 

There was submitted a note of information from the Licensing Department relative to the conduct of Mr B G, Mr B R and Mr M M during the currency of their Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the note submitted by the Licensing Department. The Sub-Committee noted that the licence holders had been observed parking indiscriminately and they had been previously warned to stop the practice. Thereafter, the Sub‑Committee agreed that a final written warning be issued to Mr B G and Mr B R and to hold a hearing in respect of Mr M M.

 

IV ANTI-SOCIAL BEHAVIOUR ETC (SCOTLAND) ACT 2004 - REGISTRATION OF CERTAIN LANDLORDS

 

There was submitted a letter of information from the Chief Constable relative to the conduct of Mr P J during the currency of his HMO Licence.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Chief Constable. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr P J to be the holder of an HMO Licence.
