Licensing Sub-committee - 21/09/2005

At a MEETING of the LICENSING SUB-COMMITTEE held at Dundee on 21st September 2005.

Unless marked thus * all items stand delegated.

 

The Sub-Committee resolved under Section 50(a)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted items of business on the grounds that this would involve the likely disclosure of exempt information as defined in Paragraphs 3, 6 and 9 of Part I of Schedule 7(a) of the above Act.

 

I CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI OPERATOR'S LICENCE - RENEWAL

 

There was submitted an application by Mr G T for renewal of his Taxi Operator's Licence.

 

The Sub-Committee noted that the applicant was not present and agreed that consideration of the application be deferred to the meeting of the Licensing Sub-Committee to be held on 17th October 2005 to allow the applicant to be present.

 

(b) TAXI OPERATOR'S AND TAXI DRIVER'S LICENCES - RENEWALS

 

Item 1

 

There was submitted an application by Mr R A for renewal of his Taxi Operator's and Taxi Driver's Licences.

 

The Sub-Committee gave consideration to Letter of Representation which was submitted by the Chief Constable relative to these applications.

 

The Sub-Committee having heard an agent for the applicant and the applicant on their own behalf and the advice of a Legal Officer agreed that the application for renewal of Taxi Operator's Licence be granted and that the application for renewal of Taxi Driver's Licence be refused.

 

Item 2

 

There was submitted an application by Mr T D for renewal of his taxi Operator's and Taxi Driver's Licences.

 

The Committee gave consideration to a Letter of Representation which had been submitted by the Chief Constable relative to these applications.

 

Thereafter, having heard a representative on behalf of the applicant the Sub-Committee agreed that the application for renewal of the Taxi Operator's Licence be granted and that the application for renewal of taxi Driver's Licence be renewed with a warning.

Item 3

 

There was submitted an application by Mr G F for renewal of his Taxi Operator's Licence and Taxi Driver's Licences.

 

The Sub-Committee noted that the applicant was not present and agreed consideration of the application be deferred to the meeting of the Licensing Sub-Committee to be held on 17th October 2005 to allow the applicant to be present.

 

Item 4

 

There was submitted an application by Mr A G for renewal of his Taxi Operator's Licence and Taxi Driver's Licences.

 

The Sub-Committee gave consideration to a Letter of Objection which had been submitted by the Chief Constable relative to these applications.

 

Thereafter, having heard an Agent on behalf of the applicants and consideration of a letter of support which had been submitted by the applicant's employer the Sub-Committee agreed that both applications be granted.

 

Item 5

 

There was submitted an application by Mr D N for renewal of his taxi Operator's and his Taxi Driver's Licences.

 

The Sub-Committee gave consideration of a Letter of Representation which had been submitted by the Chief Constable relative to these applications.

 

Thereafter, the Sub-Committee having heard an Agent on behalf of the applicant agreed that both applications be granted.

 

(c) TAXI DRIVER'S LICENCES - RENEWALS

 

Application 1

 

There was submitted an application by Mr N G for renewal of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to a Letter of representation which had been submitted by the Chief Constable relative to this application.

 

Thereafter, having heard a representative on behalf of the applicant, the Sub-Committee agreed that the application be granted.

 

Application 2

 

There was submitted an application by Mr R S for renewal of his Taxi Driver's Licence.

 

The Committee gave consideration to a Letter of Objection which had been submitted by the Chief Constable relative to this application.

 

Thereafter, having heard an agent on behalf of the applicant and the advice of a Legal Officer the Sub-Committee agreed that the application be refused.

 

Application 3

 

There was submitted an application by Ms A B for renewal of her Taxi Driver's Licence.

 

The Committee gave consideration to a Letter of Representation which had been submitted by the Chief Constable relative to this application.

 

Thereafter, having heard a representative on behalf of the applicant the Sub-Committee agreed that the application be granted for a period of one year.

 

The Convener agreed that the undernoted item of business be considered as a matter of urgency in terms of Standing Order No 17(3) and in view of the timescales.

 

(d) SUSPENSION HEARING

 

The Sub-Committee gave consideration to a letter of information which had been tabled by the Chief Constable relative to the conduct of Mr R N during the currency of his Taxi Licence.

 

Thereafter, the Sub-Committee agreed that a Suspension Hearing be held at the next meeting of the Licensing Committee.
