Clean Air Act - Furnaces and Chimney Height Approvals

Section 4 of the Clean Air Act 1993 requires for the Council to be notified of the intention to install a furnace (combustion appliance) at any non-domestic premises.

In addition, under Section 14 of the Clean Air Act 1993, the Council must determine the correct height of the chimney to avoid pollution at ground level becoming a health issue or causing a nuisance if a furnace or combustion appliance is used to do any of the following:

  • burn pulverised fuel;
  • burn at a rate of 45.4 kg or more an hour any other solid matter; or
  • burn at a rate equivalent to 366.4kW or more any liquid or gaseous matter.

This means that anyone looking to install such an appliance or furnace must first seek approval from the Council. Applications forms for such approvals can be obtained from Neighbourhood Services. According to the Clean Air Act 1993, the Council must consider an Section 14 application for the approval of a chimney height for a furnace or combustion appliance and give a written decision within 28 days of the date that the application is lodged.

In addition, the appliance may require Building Regulations approval and/or Planning permission. You should consult with the Planning and Building Control section of City Development in regards to this.
